SUBJECT:
RELEASE OF PROPOSED DOCUMENTS i
The purpose of this memorandum is to remind you of requirements in Management Directive (MD) 3.4 entitled " Release of Information to the Public." Recently, proposed conditions for several license amendments and environmental assessments have been forwarded to licensees without Office Director approval. Handbook 3.4 provides a list of documents that can be released without approval of the Office Director. These include documents characterized as necessary documents, proposed research documents, and proposed NRC documents to other Federal Agencies. Handbook 3.4 also provides a list of documents that require my approval before they can be released. These include predecisional documents such as license conditions, inspection findings, staff positions, etc.
You should review MD 3.4 and obtain my approval before releasing predecisional documents or

other documents as specified in MD 3.4.
I recognize that it is beneficial to provide NRC proposed license conditions, environmental assessmenta, technical specifications, and associated documents to licensees for review prior to taking final licensing action. By this memorandum, I am granting generic authorization to provide proposed license conditions, environmental assessments, and safety evaluations to licensees for review prior to issuing the final licensing action, provided that the documents do not involve potential enforcement actions, or senior NRC management or Commission level discussions. It is appropriate to handle these types of communications at the Branch or Division level because routine licensing actions are not normally reviewed at the Office Director level.
Therefore, you need not request my specific approval to release these proposed documents.
Note that the proposed documents should be sent to the licensee by letter, and they must be sent to the Public Document Room at the time of release.
Questions regarding this matter should be discussed with your supervisor.
