Subject: RESPONSE TO "NOTICE OF VIOLATION AND PROPOSED IMPOSITION OF CIVIL

PENALTY" (NRC Combined Inspection Nos. 50-245/87-22; 50-336/87-20;

50-423/87-13 and NRC Inspection Nos. 50-423/87-21)

We have reviewed your letter, dated January 29, 1988, in response to the Notice

of Violation and Proposed Imposition of Civil Penalty seilt to you with our

letter dated December 14, 1987. Our letter and Notice described several

violations identified during two NRC inspection:, conducted between August 31

and November 2, 1987.

In your response to the Notice, you (1) previded a check for $25,000 in full

payrient of the civil penalty; and (2) admitted all of the violations with the

exception of one example of one violation (Example A.I.b of the December 14

Notice). After careful consideration of your response, we have concluded,

for the reasons provided berein, that the violation occurred as described in

the Notice.

The specific example denied in your response intolved a glass insert on a door

which formed a portion of a vital area barrier, which, if broken, could allow

an individual to accass the inside door handle and open the door, thereby

defeating the door as a barrier. The basis for your denial, as set forth in

your response, was that (1) should the glass be broken and the door opened,

an alarm would be generated and (2) the opening that would be created by the

destruction of the broken door glass would be less than the 96 square inch

vital area barrier opening criteria stated in Paragraph 5.3.1 of the NRC-

approved security plan for Millstene.

While the NRC agr_es that the opening created by breaking the glass insert

would be less than 96 square inches (man-sized), and the door, if opened,

would alarm, the opening would nonetheless be large enough for an unauthorized

individual to reach through and manipulate the inside door handle to open the

door and thereby defeat the locked door intended as a barrier to control access.

Therefore, the class insert did not meet the barrier integrity requirements of

10 CFR 73.2(f)(2) and the violation remains as cited.
