SUBJECT: NRC INSPECTION REPORT NO. 50-361/98-14; 50-362/98-14 AND NOTICE OF  ;

VIOLATION j

Dear Mr. Ray:

From October 19 through November 6,1998, a safety system engineering inspection and a

safety evaluation inspection were conducted at your San Onofre Nuclear Generating Station,

Units 2 and 3 reactor facilities. Additional in-office review of information provided by your staff

. was conducted following completion of the onsite inspection and the exit interview.- On

December 17,1998, the results of this inspection were discussed with Jeff Cook of your staff. l

The enclosed report presents the results of that inspection.

The NRC assessed the capability of the component cooling water system and supporting i

control systems. On the basis of our review, we concluded that the component cooling water  ;

system was capable of performing its safety function. We also noted that your procedure for

the safety evaluation program was not consistent with NRC's interpretation of 10 CFR 50.59,

" Changes, Tests, and Experiments." However, your procedure included additional

management controls for the areas of exception and the NRC did not identify any cases where

these areas of exception had resulted in your staff inappropriately approving changes to the

. facility as described in the Updated Final Safety Analysis Report.

Based on the results of this inspection, the NRC has determined that a violation of NRC  !

requirements occurred. Since original construction, the design basis to properly classify the

electrical control of component cooling water miniflow control valves that was specified in the

' license application, was not properly translated into the plant design. The violation is cited in

the enclosed Notice of Violation (Notice) and the circumstances surrounding the violation are

described in detail in the enclosed report. This violation is of concern because your staff had

two prior opportunities to correct this issue. Please note that you are required to respond to this

letter and should follow the instructions specified in the enclosed Notice when preparing your

response. The NRC will use your response, in part, to determine whether further enforcement

action is necessary to ensure compliance with regulatory requirements.

One unresolved item was identified concerning control of the thermal performance of the l

auxiliary salt water / component cooling water heat exchangers. This matter is discussed in

Section E2.2 of the enclosed ins'pection report. This item is unresolved pending NRC review of

the results of your planned testing to better estimate the total tube wall fouling of these heat '

exchangers and your evaluation of past operability. Additionalinspection is also planned to

confirm that the mathematical models used by your staff to analyze the impact of macro-fouling

are conservative.
