October 2, 2020 ALL AGREEMENT STATES, NRC NMSS, NRC REGIONS I, III and IV NOTIFICATION OF THE ISSUANCE OF THE FOLLOWING 13 PROCEDURES RELATED TO THE INTEGRATED MATERIALS PERFORMANCE EVALUATION PROGRAM (STC-20-070):

SA-100, IMPLEMENTATION OF INTEGRATED MATERIALS PERFORMANCE EVALUATION PROGRAM (IMPEP);

SA-101, STATUS OF MATERIALS INSPECTION PROGRAM; SA-102, TECHNICAL QUALITY OF INSPECTIONS; SA-103, TECHNICAL STAFFING AND TRAINING; SA-104, TECHNICAL QUALITY OF LICENSING ACTIONS; SA-105, TECHNICAL QUALITY OF INCIDENT AND ALLEGATION ACTIVITIES; SA-106, THE MANAGEMENT REVIEW BOARD; SA-107, LEGISLATION, REGULATIONS, AND OTHER PROGRAM ELEMENTS; SA-108, SEALED SOURCE AND DEVICE EVALUATION PROGRAM; SA-109, LOW-LEVEL RADIOACTIVE WASTE DISPOSAL PROGRAM; SA-110, URANIUM RECOVERY PROGRAM; SA-200, COMPATIBILITY CATEGORIES AND HEALTH AND SAFETY IDENTIFICATION FOR NRC REGULATIONS AND OTHER PROGRAM ELEMENTS; AND SA-201, REVIEW OF STATE REGULATORY REQUIREMENTS.

Purpose:

To inform the National Materials Program that the U.S. Nuclear Regulatory Commission (NRC) staff has issued the 13 Office of Nuclear Material Safety and Safeguards State Agreements (SA) procedures as final.

Background:

In State and Tribal Communications (STC) letters STC-19-078, STC-19-079, STC-20-004, and STC-20-005, NRC issued for use, and requested comments on the interim SA procedures. The STC letters requested comments by April 1, 2020. The comment response date was subsequently extended to July 1, 2020 (See STC-20-028).

STC-20-070 2 Discussion: Based on the comments received, the NRC staff has revised the procedures, and are issuing them as final. A summary of the public comments on the revised SA procedures and NRC staff responses is available at Agencywide Documents Access and Management System (ADAMS) Accession No. ML20183A152.

The final SA procedures will be posted on the State Communications Portal (SCP) public Web site at: https://scp.nrc.gov/procedures.html. The respective Word and redline strikeout versions for all the revised procedures are available in ADAMS Package Accession No. ML20183A179. These procedures are available for immediate use by all stakeholders. Please note that most of the appendices (i.e., the Examples of Less than Satisfactory Findings of Program Performance from the common and non-common IMPEP performance indicators; the casework summary sheets, and inspector accompaniment summary sheets) have been removed from the interim procedures and will be posted on the IMPEP toolbox at:

https://scp.nrc.gov/impeptools.html). The appendices will be placed on the SCP Web site to allow for dynamic revisions.
