HIGHLIGHTS OF WEEKLY INFORMATION REPORT i

WEEK ENDING SEPTEMBER 23, 1988 Decomissioning of Fort St. Vrain Reactor l

Decomissioning of the Fort St. Vrain reactor is being considered by the l licensee, Public Service Co., of Colorado. At the request of the licensee, '

representatives of NRR and NMSS/LLWM are planning to tour the Fort St. Vrain reactor facility and then meet with the licensee and State of Colorado staff l to discuss potential decomissioning of the reactor plant.

Nuclear Fuel Services. Inc. (NFS)

On Septenber 19, 1988, NRC staff (OGC and NMSS) met with an NFS Corporate Official to discuss NFS' intent to withdraw escrow funds in connection with the decomissioning of the holding ponds at its facilities in Erwin, Tennessee.

According to the NFS escrow agreement a withdrawal may be made when NFS presents certification to the escrow a,0ent that decomissioning is proceeding pursuant to an NRC-approved plan and that NRC has been given prior notice of NFS' intent to withdraw funds. In this case, NFS plans to use escrow funds to reroute Banner Spring Creek, which currently traverses the holding pond area. The NRC staff agrees that the rerouting of the creek is a necessary and integral part of the pond decomissioning. NFS is seeking the necessary State approvals for this action.

Peach Bottom Exercise Interhee Meetings with Maryland and Pennsylvania William Russell, who will be the Director of Site Operations during the Peach Bottom exercise, and members of his staff met with senior State officials in Maryland and Pennsylvania on September 19 and 22, respectively. The discussions focused on the NRC response roles, State response roles and facilities. Both States' emergency operations centers and dose assessment centers were toured and exercise logistics were discussed.

Event at Wright-Patterson Air Force Base At the request of the Department of the Air Force, the staff held a transcribed meeting on September 15, 1988 with the Air Force regarding the June 17, 1988 Notice of Violation and Prososed Imposition of Civil Penalty in the amount of

$102,500. This action was based on an inspection and investigation of an event at Wright Patterson Air Force Base near Dayton, Ohio and involved the failure to report a significant spill of americium-241 and an overexposure.

In its response The Air Force the Air Force (1) responded to the denied the civil penalty reporting on July)15, violation, 1988.

(2 stated that it considers the civil penalty to be unjustified, and (3) questioned the constitutional '

authority concerning the NRC's jurisdiction to impose a civil senalty on the Air Force (another Federal agency). The staff is evaluating tie Air Force's response.

Temporary Parking Lot at OWFN Clearing and grading of the lot behind OWFN this week signaled the start of construction for the temporary parking lot that Montgomery County requires the developer to provide in fulfillment of promises made when the building permit for the first building was granted. The estimated time of completion is the latter part of November.

OFFICE OF NUCLEAR REACTOR REGULATION ITEMS OF INTEREST Week Ending September 23, 1988 Calvert Cliffs At approximateiy 9:30 a.m. on September 15, 1988, three BG&E Material Engineering and Analysis the No. 11 condensate storageUnit tankemploy (ees were making preparations to enterCST), I which is to effect repairs on the tank level indicator. The employee who was to enter the tank is a diver. The diver was unable to enter the tank while wesring his oxygen breathing apparatus. Consequently, he decided to enter the CST and don the breathing gear once inside. Once inside, the diver fell into the water.

The cause of this fall has not been determined yet. The two workers atop the l CST attempted to pull the diver out using the diver's safety line but were l unsuccessful. At that )oint, one of these two employees, who was not a diver.  :

jumped into the CST witicut any breathing apparatus or a safety line. He was seen to disappear beneath the water and aoparently drowned. The third employee imediately called to another employee located near the base of the CST who then imediately informed the control room of the accident at 9.55 a.m.

The circumstances existing at the time of entry into the CST appear to be as follows:

l 1. Entry may have been made into the CST without the required enclosed space l permit and without following the required procedures.

l 2. The centrol room operators were aware of p!anned CST work.

3. The CST was still in service and being used to provide makeup feedwater to the Unit I condenser hotwell.

4 The employees may :.dve "sniffed" the CST atmosphere near the top of the CST but not deeper in the tank.

5. The CST had not been deinerted other than the superficial diffusion thac occurred at the top of the CST when the manway was opened.
6. It is unknown whether nitrogen had been secured to the CST prior to en'.<y.
7. There was no internal lighting provided for the CST.

After notification, the control room secured suction from the CST and dispatched medical safety teams to the CST. They were able to retrieve the diver who was in respiratory depression. Through CPR, they were able to restore his breathing after which he was hospitalized. The plant also notified Calvert County and the Maryland State Police who dispatched 3 rescue divers to the scene. After partial draining and deinerting of the CST, these divers entered the CST at 12:20 p.m.

and recovered the deceased worker at 1:18 p.m.

The license has notified State of Maryland, the NRC and OSHA regarding this fatality.

2 Shoreham On September 15, the New York State Public Service Comission voted 6 to 1 to accept the Shoreham settlement agreement, subject to LILCO stockholders' -

acceptance.

In a related matter, according to the press, the U.S. Internal Revenue Service has given tentative approval for the 2.5 billion dollars worth of tax '

write offs for closing Shoreham.

OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending September 23, 1988 SAFEGUARDS Transportation Plutonium Air Shipment On September 19, 1988, SGTR and OGC staff met with representatives of Japan to discuss funding for implementation of the Murkowski Amendment. Based on the meeting, the staff is developing an agreement for reimbursement of costs to NRC and to generally outline the program for implementation of the Hurkowski Amendment.

LOW-LEVEL WASTE MANAGEMENT Decomissioning of Fort St. Vrain Reactor Decomissioning of the Fort St. Vrain reactor is being considered by the licenste, Public Service Co., of Colorado. INDUSTRIAL AND HEDICAL NUCLEAR SAFETY Fuel Cycle Safety Nuclear Fuel Services. Inc. (NFS)

. o OFFICE Of NUCLEAR REGULATORY RESEARCH Items of Interest Week Ending September 23, 1988 PREVENTING DAMAGE TO REACTOR CORES Waterhammer Guidebook A guidebook "Diagnosis of Condensation Induced Waterhammer," has been produced by CREARE, Inc. and accepted for publication as NUREG/CR-5220. The guidebook provides analytical diagnostic methods and their application to actual water-hammer events in nuclear power plants. Many photos of waterhammer damage are illustrated throughout the text. The guidebook will assist inspectors and licensees in the diagnosis, mitigation and prevention of waterhammer events.

Items of Interest Office for Analysis and Evaluation of Operational Data Week Ending September 23, 1988 Otagnostic Evaluation and Incident Investigation During the period from September 19-23, 1988, the Fermi Diagnostic Evaluation Team (DET) continued efforts to complete the final integrated performance evaluation and root cause assessment. Preparation of the initial draft of the Fermi DET report was also begun during this period.

Incident Response On September 19. IRB staff met with RES and the Oak Ridge National Laboratory (ORNL) concerning thv staff's view on the use of "Expert Systems" in Incident Response.

On September 20, an IRB staff member attended a meeting of the Group to Rewrite the Federal Radiological Entgency Response Plan (FRERP) based on lessons learned from the Federal Field Exercise-2 (FFE-2), Chernobyl and the National System for Emergency Coordination (NSEC).

On September 20-21, IRB staff conducted training for the Regional Administrator and Senior Staff Region I on NRC Standard Technical Procedures and Computer Systems that would be used to assess protective measures during an emergency.

On September 20, IRB staff participated on a limited basis with Oconee during an exercise. .

On Septen>ber 23,1RB staff met with NRR, RES and the Nuclear Utility Management and Resources Committee (NUMARC) to review the Emergency Action Level (EAL)

Interim Report of the NUMARC EAL Task Force.

During the weeks of September 19-23 and September 25-30, the IRB staff will be working with representatives of the Idaho National Engineering Laboratory (INEL) on the Reactor Safety Assessment System.

Technical Training Center (TTC)

Two members of the TTC staff presented a Boiling Water Reactor (BWR) Technology Course in Mexico on September 12-23, 1988. The course, requested by the Mexican Government through the International Atomic Energy Agancy (IAEA) and Government and Public Affairs (GPA), was conducted at the Comision Nacional de Saguridad Nuclear y Salvaguardias (CNSNS) headquarters in Mexico City. This is the fourth course that the NRC has presented at the request of the Mexican Government since 1977. Reactor technology courses on behalf of NRC foreign counterpart agencies have been presented in seven different countries.

ITEMS OF INTEREST OFFICE OF GOVERNMENTAL AND PUBLIC AFFAIRS WEEK ENDING SEPTcNBER 23, 1988 INTERNATIONAL PROCRAMS Foreign Visitors On Monday a French government and utility technical team met with staff from NRR, RES, AE00 and GPA/IP to discuss US fire protection philosophy and requirements for power reactors.

US/ EURATOM Annual HEU Supply Meating The Annual US-EURATOM Supply Agency meeting on US supply of highly enriched uranium (HEU) was held on Friday September 16, at EURATOM's Washington office.

The EURATOM delegation was led by Juergen Jaspert of the Supply Agency and included representatives from CEA (France) CEN (Belgium) HFR-Petten. HFR-Grenoble. NUKEM, Transnuclear (Paris) and Transnuclear (US). Carl Thorne.

Director, OES/NEC, headed the US team which included representatives from NRC, DOS, DOE, ACDA, Oak Ridge Operations Office, and Argonne National Laboratory.

Betty Wright, GPA, and Joanna Becker, OGC, were the NRC attendees, Jaspert emphasized EURATOM's need for more predictability and reliability on the part of the US as a supplier of HEU. He also expressed concern regarding US land transportation arrangements for HEU exports. In the absence of any US comercial capability for land transport of HEU. DOE has agreed to provide the Safe Secure Transport (SST) for the upcoming HEU shipment scheduled for late September, but the US remains unable to guarantee such arrangements for the future.

Jaspert also asked the DOE representative when the Federal elegister Notice would be published on the extension of DOE's reprocessing policy for research reactor fuels, and he expressed concern regarding possible price increases.

DOE stated that cost studies are under way and that DOE hoped to publish the new reprocessing policy by the end of November 1988.

Carl Thorne closed the meeting by indicating that the US would review our export licensing procedures to determine if improvements could be made for more timely processing of HEU ex continuetorequireacaseportrequests;however,mostHEUrequestswouldoy-case r STATE, LOCAL AND !NDIAN TRIBE PROGRAMS Cenference of Radiation Control Program Directors' Executive Comittee Feeting Carl Kamerer, Director of State Local and Indian Tribe Programs, hosted the Conferer.ce of Radiation Control Program Directors' Executive Comittee meeting on September 20-22, 1988 at the One White Flint North. The purpose of the meeting was to plan Conference activities for the upcoming fiscal year.

Joint Meeting on Mixed Waste Program Implementation On September 22, 1988 Marie Miller, Region I State Liaison Officer, participated in an EPA Region !! meeting with the New Jersey Department of Environmental Protection. The discussion included overviews of agencies' roles for inspection of mixed waste facilities and possible coordination agreements.

EXPORT / IMPORT WEEKLY POINTS OF INTEREST During the week ending September 23, 1988, applications for export licenses were received from:

1) Combustion Engineering for the export of irradiated fuel rods for post-irradiation examination at Chalk River Nuclear Laboratories in Canada to evaluate the perfomance of coninercial PWR fuel irradiated to high burn-up.

The export will consist of the irradiated fuel, reactor control rod assembly, one non-fueled rod and one fuel element assembly cage.

2) Intercontinental Energy Corporation for the export of 8,400 kgs of natural uranium to Canada for conversion from U038to UF 6and return to the U.S.
3) General Electric Company for the authorization to ship 15.400 kgs of Canadian-origin material to Spain for use as fuel in the Cofrentes Power Reactor.

During the week ending September 23, 1988, licenses for export were issued to:

1) Transnuclear, Inc. for the export of 5,465.713 kgs of Australian-origin material to West Gemany for use as fuel in the Unterweser ! Power Reactor.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 was issued on September 16, 1988 to Comonwealth Edison Company (Braidwood Nuclear Power Station). The action was based on two separate examples of inattentiveness on the part of security officers assigned as compensatory measures for an unlocked and unalarmed vital area door.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 was issued on September 19, 1988 to Pennsylvania Power and Light Company (Susquehanna Units 1 and 2). The action was based on a violation of the equipment qualification requirements of 10 CFR 50.49. (EN 88-75)

A Notice of Violation and Proposed Imposition of Civil Penalties in the amount of $150,000 was issued September 20, 1988 to Baltimore Gas and Electric Company (Calvert Cliffs Units 1 and 2). The action was based on two events in which Technical Specification Limiting Conditions for Operations were violated. In the first, one of the two emergency diesel generators required for Unit 2 was inoperable for approximately 48 hours5.555556e-4 days <br />0.0133 hours <br />7.936508e-5 weeks <br />1.8264e-5 months <br /> because the voltage regulator was left in manual after testing. In the second, all the variable high level and axial offset Reactor Protective System instrumentation channels on Unit I were set less conservative than required. The base civil penalty was escalated by 50%

for each of these violations. The first violation was escalated because of poor prior perfermance and the second violation was escalated because of prior notice of a similar problem. (EN88-76)

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $1.600 was issued September 20, 1988 to Payne and Payne, Inc., Shawnee, Oklahoma. The action was based on failures to calibrate, perform surveys, evaluate personnel dosimetry, leak test and inventory sealed sourcer, enter into an agreement with well operators as owners or to responsibilities in event of a down-hole irretrievable source, and follow DOT regulations. The base civil penalty was increased by 100% for multiple examples ar.d duration.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $75,000 was issued September 21, 1988 to Power Authority of the State of New York (Indian Point 3). The action was based on a violation of the equipment qualification requirements of 10 CFR 50.49. Because of the licensee's prompt and extensive corrective actions to some of the problems, the penalty was reduced by 50%. (EN 88-78)

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $187,500 was issued on September 22, 1988 to Consumers Power Company (Big Rock Point). Other At the request of the Department of the Air Force, the staff held a transcribed meeting on September 15, 1988 with the Air Force regarding the June 17, 1988 Notice of Violation and Proposed Imposition of Civil Penalty in the amount of

$102,500. This action was based on an inspection and investigation of an event at Wright Patterson Air Force Base near Dayton, Ohio and involved the failure to report a significant spill of americium-241 and an overexposure.

In its response The Air Force responded to the Air Force (1) denied the reporting violation, (2 stated that it considers the civil penalty on July)15, 1988.

the civil penalty to be unjustified, and (3) questioned the constitutional authority concerning the NRC's jurisdiction to impose a civil penalty on the Air Force (another Federal agency). The staff is evaluating the Air Force's response.

OFFICE OF C0NSOLIDAT10N Items of Interest Week Ending September 23, 1988 Planning for Two White Flint North A series of planning assumptions for NRC's second building have been established at meetings between NRC staff and representatives of GSA, Tower Construction Company, and Dewberry & Davis. These assumptions, which are preliminary and subject to change, include the following:

1. An auditorium will be located on the "A" and "B" levels between the two buildings.
2. There will be a day care center on the "A" floor at ground level.
3. There will be seven passenger elevators and one freight elevator in the central core of the building, as well as a small elevator to provide access for handicapped persons from the street level down to the auditorium.
4. There will be a physical fitness center at TWFN, which will probably be located on the lith floor. The NRC Health Unit will remain in OWFN, but will be expanded to handle the additional patient load.
5. Each "typical" floor will have copy rooms, lounges, vending and coffee rooms, a CPU / file server room, and large, medium, and small conference those in(The rooms. lar OWFN.) ge conference A typical floor will alsorooms willworkstations, have PC be about 20 percent bigger than NUDOCS workstations, and space for word-processing printers.
6. The meeting and hearing rooms for ACRS, ASLAP, and ASLBP will be designed without removing columns.

8. The first floor will house the cafeteria, the credit union, and an exhibit area - if the Montgomery Coun g planning Board will grant approval. The county has )reviously specified to the developer that the entire first floor must >e reserved for "retail space."
9. Floor two Nill house the NRC Library and the Public Document Room.
10. Floor three will house ACRS, ASLAP, and ASLBP, and the meeting and hearing rooms for those offices.
11. Floor four will house the document control center and some 3f its contractor employees, duplication services, and publications distribution.

12. Floor five will house the remainder of the document control contractor employees, the photo lab and audiovisual studio, information technology services and graphics support, electronic composition and text processing services, and other ARM staff.

14. Floors seven through eleven will house RES, DIA, OP, OSDBUCR, and parts of AE00 and ARM.
15. Floor twelve will be lef t vacant to provide room for future expansion.

Temporary Parking Lot at OWFN Clearing and grading of the lot behind OWFN this week signaled the start of construction for the temporary parking lot that Montgomery County requires the developer to provide in fulfillment of promises made when the building permit for the first building was granted. The estimated time of completion is the latter part of November.

Traffic Survey In preparation for the subdivision hearing on TWFN, which will probably be scheduled for November, the developer conducted a new survey of the traffic at nearby intersections this week. Consultants will analyze the data and prepare a report before the hearing.

1. On September 19, representatives of the Georgia Institute of Technology, Neely Nuclear Research facility, were in the Region II Office to attend an Enforcement Conference.
2. On September 20, representatives of the Carolina Power and Light Company were in the Region !! Office to attend a Management Meeting to discuss the Design Basis Reconstitution problem at their Robinson Nuclear Power facility.
3. On September 21, the Regional Administrator and selected members of the Region II staff were at the Turkey Point Nuclear Power Station to present the SALP Board Assessment to Florida Power and Light Company representatives.

4 On September 21, representatives of the Georgia Power Company were in the Region II Office to participate in a working level meeting with NRR and Regional representatives concerning implementation of actions specified in IE Bulletin 85-03 (motor operated valves).

5. On September 21, an Enforcement Conference was conducted at the Maryview Hospital in Portsmouth, Virginia, regarding violations in their radiation safety program that were identified during a recent inspection.
6. On September 23. Mr. Ying Zhen Zhang, from the People's Republic of China, accompanied by J. MacKinnon of AE00, was in the Region II Office. Mr. Zhang has been assigned to AEOD under an IAEA Fellowship. He will be developing programs in operating experience assessment and feedback and incident response for China's National Nuclear Safety Administration.
