APPLICATION FOR AhlENDNIENT TO OPERATING LICENSE Pursuant to Section 50.90 of the regulations of the Nuclear Regulatory Commission, the New York Power Authority, as holder of Facility Operating License No. DPR-59, hereby applies for an Amendment to the Technical Specifications contained in Appendix A of this license.

This proposed amendment to the James A. FitzPatrick Technical Specifications reflects changes to the reactor vessel water level instrumentation system. In accordance with the requirements of Regulatory Guide 1.97 and Generic Letter 84-23, changes to the instrumentation system are made to reduce instrument errors resulting from post-accident containment heat-up and to increase the redundancy and reliability of Control Room indication.

Incl'.ided with this application are changes to the Technical Specification which remove obsolete reactor vessel water level instrument setpoints. In accordance with the guidance of NUREG-0737 Item II.K.3.27, a common instrument zero corresponding to the top of active fuel (TAF) has been implemented in the Technical Specifications and is to be fully integrated into plant instrumentation, procedures, and training. The original setpoints, referenced to the bottom of the steam separator skirts (the original instrument zero), have been rendered obsolete.

A change is also being made to reflect a plant modification performed to meet the requirements of NUREG-0737 Item II.K.3.13. The modification to the RCIC system replaced the turbine trip at high reactor water level with a recoverable steam line isolation. The Authority did not consider the change necessary at that time, but is now making the change to clarify the Technical Specifications.

The proposed amendment changes Specification and Bases 2.1.A.2, Bases 3.2, Tables 3.1-1, 3.2-1, 3.2-2, 3.2-6, and 3.2-7 on pages 11,18, 41a, 64, 55, 66, 67, 76, 76a, and 77 and adds a new page 76d.

The proposed changes to the Technical Specifications are Attachment I to this Application for Amendment to the Operating License. The Safety Evaluation for the proposed changes is included as Attachment II.
