Potential Withdrawal.

Dear Mr. Thomas:

With reference to our recent conversations concerning the impact (if any) on NRC and the legal status of IEEE 279-1971 if this standard should be withdrawn by IEEE, I requested a legal opinion on this matter from Mr. Eric Jakel, Office of Executive Legal Director, NRC.

Mr. Jakel's legal opinion is as follows:

" Paragraph (h), " Protection systems," of 10 CFR 50.55a, " Codes and Standards," incorporates by reference the provisions of IEEE 279.

Paragraph (h) provides, in part, i-For construction permits [for light-water-cooled nuclear

For the purposes of 10 CFR 50.55a(h), the NRC determines when a par-ticular edition or revision of IEEE 279 becomes "in effect" and when l

it has been superseded.

the requirements of 10 CFR 50.55a(h). To impose different require-ments upon CP applicants. the NRC would have to amend 350.95a(h) and footnote 7 through the rulemaking process.*
