" Notice of Violation," in the NRC Inspection Report 70-1113/84-16, dated 2/13/85.

10 CFR 70.57(b)(11) requires the licensee to establish a statistical control system designed to monitor the quality of each type of program measurement.

Control chart limits shall be established to be equivalent to levels of significance of.05 and.001.

Whenever control data exceed the.05 control limits, the licensee shall investigate the condition and take corrective action in a timely manner.

The sbove requirement was clarified in a letter to the licensee dated May 14, 1984, which specified the meaning of "in a timely manner" as it pertains to the context of 10 CPR 70.57(b)(11).

The letter instructed the licensee to implement this requirement by establishing a program to report the occurrence of a single or two consecutive data points that fell between the 0.05 and 0.001 control limits to the measurement control coordinator or his officially designated alternate within 48 and 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />, respectively.

Contrary to the above, between October 8 and November 8, 1984, sixteen control measurements fell between the 0.05 and 0.001 control limits and neither the measurement control coordinator nor his officially designated alternate were notified as of the date of the inspection.

This is a Severity Level IV violation (Supple-ment III).

Control data for the laboratory measurements that fall between the 0.05 and 0.001 limits are currently reported to a laboratory supervisor as they occur.

Only conditions that exceed the 0.001 levels are reported to the measurement control coordinator.

GE is in the process of reviewing the response mechanisms now in place for the major ID contributors identified in Section 4.5.3 of the Fundamental Nuclear Material Control Plan.

Upon completion of this review, GE will (1)

Determine what delegations to issue to best meet the intentions of the May 14, 1984, generic letter for the major ID contributor streams; (2)

Propose appropriate FNMCP changes and (3)

Request an exemption to apply the reporting criteria to the major measurement systems.

Upon completion of these efforts by June 14, 1985, and the NRC's approval of the requested exemption, General Electric will be in full compliance.

The reason tor the violation was an omission of the procedural description in the FNMCP.

This procedural description was omitted from the FNMCP as it appeared redundant and overly detailed for this document.

In order to avoid a further v lation on this issue and to assure that the manner in which uranium factors are obtained is clearly documented, a descrip lon of this methodology will be added to the FNMCP and submitted to the NRC for approval by December 31, 1984.

General Electric will be in full compliance upon receipt of NRC approval.

10 CFR 70.51(f)(4) requires that the licensee conduct physical inventories accordinc to written inventory instructions.

Contrary to the above, scales and balances used for the August 1984 physical inventory were calibrated by the licensee rather than by the scale vendors as was specified by the licensee's inventory instructions, entitled August 1984 Uranium Inventory Preparation Activities, dated July 3, 1984.

This is a Severity Level V violation (Supplement III).

General Electric denies that this violation existed.

The proposed violation of 10 CFR 70.51(f)(4) was developed as the result of the phrase " appropriate scale vendor" used in an internal memo (Exhibit A) relatino to inventory planning.

It was

was generated as a part of the requirements of P/P 140-1 (Exhibit B), specifically Sections 2.1.2 and 4.6 through 4.9.

However, Sections 2.1.3 and 4.13 of P/P 140-1 do address the requirements of 10 CFR 70.51(f)(4).

To our knowledge, these instructions are compete and contain no deficiencies.

The phrase " appropriate scale vendor" is a proper description for obtaining scale and balance work.

This is evidenced by the responsibilities, requirements and procedures defined in P/P 70-25 and QIEP B-40.1 (Exhibits C and D).

Notwithstanding the discussions of 10 CFR 70.51(f)(4), the important fact is that.the scales and balances were in a condition of current calibration as defined in our approved procedures and NFMD took special steps to make sure this task was performed immediately prior to the physical inventory verification, regardless of whether the routine calibration cycle recuired it.

General Electric, therefore, contends that the referenced operations have been in full compliance and no corrective action is anticipated.
