Reference:

This is about our October 1,1996, telephone conversation and your facsimile transmission to this office, in which you expressed concerns regarding the qualified life of g You also indicated that you brought these issues to licensee management's attentian and you believe you were the subject of harassment and retaliation by management.

Additionally, you provided information that you had filed a complaint with the U.S.

Depanment of Labor (DOL) against Southern California Edison Company alleging violations of the Energy Reorganization Act. We have subsquently received an October 3,1996 letter to you from DOL, which concluded that your termination was found to be part of a planned reduction in force, and that there was no indication you were coerced or under duress to accept early retirement. We are' continuing our review of your emplo ment discrimination concern to determine whether a Violation of our requirements occurred. You will be advised by separate correspondence when our review of this matter has been completed.

An enclosure to this letter documents your concerns, as I understmd them. We will initiate actions to examine the facts and circumstances regarding your concerns. We will make every effort to handle your technical concerns so as not to disclose the source of our information, unless you do not have any objection to being identified. Some of our o

$h procedures to ensure this include limiting access to documents that contain your identity, and g,I preparing documentation in which your identity is concealed. Additionally, we will ilmit the dissemination of your identity within NRC on a strict need-to-know basis. However, if we em[

determine that the concerns that you have provided pose an immediate health and safety risk, these concerns and your identity may be provided to the licensee for prompt review and ooh resolution. If possible, we will attempt to advise you before notifying the licensee.

l NRC could be compelled to reveal your identity by order or subpoenas issued by courts of l

law, hearing boards, or similar legal entities. In such cases, the basis for protecting your I

identity and any other facts will be communicated to the authority ordering the disclosure. If this effort proves unsuccessful, we will attempt to inform you of any such action before we i

disclose your identity. Additionally, your identity will be disclosed during our investigation of your employment discrimination complaint. If we are unable to use your identity during our investigation, we will not be able to adequately investigate the matter.

We will consider you to have released the NRC of the responsibility of protecting your identity if you take any action that may be expected to disclose yourself as having provided this information to NRC. Additionally, the same applies, if you provide (or have previously provided) information to any other party that contradicts the information you provided the NRC, or if you have intentionally provided false information to the NRC.

Information regarding the subject of your allegation may be released in response to a request under the Freedom of Information Act (FOIA). However, your identity and other personal identifiers will be redacted to the extent permitted under FOIA.

In closing, let me assure you that every effort will be made to resolve your concerns. We will advise you when we have completed our review of this matter. However, should you have any questions during the interim regarding this matter, please call me.
