NOTICE OF VIOLATION Duquesne Light Company Docket No. 50-334 Beaver Valley Power Statim , Unit 1 License No. OPR-66 EA 88-83 During an NRC inspection r.onducted on March 3-8, 1988, NRC inspectors reviewed the circumstances associated with a violation identified by the licensee and reported to the NRC. In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1987), the violation is set forth below:

Technical Specification Limiting Condition for Operation 3.3.2.1 requires, in part, that whenever the reactor is in the power operation, startup, or hot shutdown modes, the engineered safety feature actuation system instrumentation channels shown in Table 3.3-3 shall be operable.

Table 3.3-3 specifies that a minimum of three of the four containment pressure High-High channels shall be operable for automatic actuation of the containment spray systems (CSS) and phase "B" containment isolation (CIB).

Technical Specification LC0 Action Statevent 3.3.2.1.b specifies that when the number of operable channels is one less than the totai number of chanrels (4), the licentee shall demonstrate that the required number of minimum channels operable (3) is met within 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br />. Ooeration may continue with the inoperable channel bypassed and one additional channel may be bypassed for up to two hours for testing in accordance with Technical Specification Surveillance Requirement 4.3.2.1.

Contrary to the above, between about 7:30 a.m. on February 24, 1988 and about C,:30 a.m. on March 3, 1988, while the reactor was at various times in the hot shutdown, startup or power operation modes, the required minimum number of operable high-high containment pressure channels (3) was not maintained in that two of the four channels for CSS actuation and CIB isolation were inoperat'le because their associated bistables were in the bypassed position.

This is a Severity Level III violation (Supplement I)

Pursuant to the provisions of 10 CFR 2.201, Duquesne Light Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident Inspector, within 30 days of the date of the letter transmitting this Notice.

This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation if admitted, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further viola-tions, and (4) the date when full compliance will be achieved. Consideration may be given to extending the response time for good cause shown.
