PROPOSED RULE: EXPAND APPLICABILITY OF PART 72 TO HOLDERS OF, AND APPLICANTS FOR, CERTIFICATES OF COMPLlANCE AND THEIR CONTRACTORS AND SUBCONTRACTORS (WITS 9600160)

We have reviewed the subject document in your memorandum dated April 16,1998. We concur with the designation of the regulation as Category "NRC.* However, we recommend the description on page 14, Compatibility of Agreement State Regulations be revised to be consistent with the language in Management Directive 5.9, " Adequacy and Compatibility of Agreement State Programs." The language is as follows: "The NRC prograrn elements in this category are those that relate directly to areas of regulation reserved to the NRC by the AEA or the provisions of Title 10 of the Code o/Federa/ Regulations," and "Although an Agreement State may not adopt program elements reserved to NRC, it may wish to inform its licensees of certain requirements via a mechanism that is consistent with the particular State's administrative procedure laws, but does not confer regulatory authority on the State."
