PROPOSED RULE: PART 72 (WITS 9600160)

OE has reviewed the proposed rule submitted for review on April 16,1998. OE has no objection to it. However, OE remains of the view that this rulemaking should provide for civil penalties for certificate holders whose violation causes the holders of General or specific licensees to be in violation of NRC requirements. In my view, if we have the authority for the wrongdoer rule to issue civil penalties to contractors who cause deliberate violations, we should have the authority to issue civil penalties to certificate holders who cause violations. In addition, section 72.86 should be reviewed to determine whether sections should be deleted from that provision, cc:
