APPENDIX A -

NOTICE OF VIOLATION GPU Nuclear Corporation Docket No. 50-219 Oyster Creek Generating Station License No. OPR-16 As a result of the inspection conducted on May 21, 1988 - July 26, 1988, and in accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (Enforcement Policy) (1988),

the following violation was identified:

A. 10 CFR 50.59 requires that licensees obtain Commission approval for facility changes that involve an unreviewed safety question. An unreviewed safety question, as defined in 10 CFR 50.59, is an increase in the probability of occurrence of an accident or malfunction of equipment important to safety previously evaluated in a safety analysis report.

Contrary to the above, the ifcensee performed an evaluation per 10 CFR 50.59 that accepted a calculated reduction in stress margins, below levels previously established by the NRC, which represented an increase in failure probability for two piping systems attached to the containment suppression pool. Although more sophisticated calculations performed subsequent to the NRC inspection demonstrated that thi piping stresses are below established allowable values, acceptance of the original stress calculations without NRC approval was not in accordance with the provision of 10 CFR 50.59 as stated above.

This is a Severity Level IV violation.

Pursuant to the provisions of 10 CFR 2.201, GPU Nuclear Corporation is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, s including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; l and, (3) the date when full compliance will be achieved. Where good cause is i shown, consideration will be given to extending this response time.  !
