, HIGHLIGHTS OF WEEKLY INFORMATION REPORT WEEK ENDING APRIL 15, 1988 ,

Peach Bottom On April 8 an Atomic Safety and Licensing Board, which was established on April 6, issued an Order relating to Pennsylvania's Petition for a hearing on Peach Bottom organizational changes. The Order provided for the filing of any contentions and amendments to Pennsylvania's petition by April 25. The licensee's and the staff's responses are to be filed within 10 and 15 days of receipt of <

Shipments of HEU from the DOE Facility at Oak Ridge i

The manager of DOE Oak Ridge operations has been withholding shipments of HEU to NRC licentees (fixed site and export) because of safeguards concerns l steming from a DOE Order issued on February 9,1988. This Order requires a higher level of physical protection for certain categories of HEU (other than Category I) than presently required by NRC regulations. Staff is working with l

DOE Headquarters and Field Offices to resolve this matter. The imediate concern is shipments of HEU to Canada under an existng export license.  ;

i NRC Drug Testing Plan 1

HHS Drug Testing Guidelines were published April 11, 1988. This clears the path for HHS certification of NRC's Drug Testing Plan. HHS must certify NRC's i Drug Testing Plan prior to NRC being allowed to begin drug testing.

Approval of Second Building Recomended ,

Phase 2 of NRC's consolidation process took a giant step forward on April 14 when the Maryland National Park and Planning Comission (MNCPPC) recomended that the Montgomery County Council approve the plan to build a second office building for NRC on the White Flint site. The recomendation was based on NRC's fulfilling two conditions: (a) the peak-hour automobile trip generation rate from the two buildings must not exceed 640 (the number previously approved for the project when the developers were planning on a hotel-conference center for the second stage of the development); and (b) the population of the two buildings combined will not exceed 2,450 persons, unless NRC can demonstrate that a greater number will not cause the trip generation rate to exc6ed 640.

The next steps in the decision process are a review by the County Council of  !

the Comission's recumendation, and then an application to the MNCPPC for l

approval of the developers' subdivision plan for the site.

. INDUSTRIAL AND MEDICAL NUCLEAR SAFETY Fuel Cycle Safety BP Chemical (VISTRON)

On April 8, 1988, NMSS staff members met with BP Chemical, BP's consultant NES, and ORAU to discuss the decontamination of the catalyst plant in Lima, Ohio. While considerable effort has been expended in the decontamination effort to date, some additional surveys and assessments will be required before a determination een be made to release the catalyst plant for unrestricted use.

B&W Fuel Company - Commercial Nuclear Fuel Plant NMSS staff met with B&W representatives on April 11, 1988, to discuss B&W's renewal application. The topics of discussion for renewal included an overview of the newly established partnership, updated process activities, and proposed future activities.

West Valley Demonstration Project The NRC staff issued a Safety Evaluation Report on the liquid Waste Treatment System (LWTS), completing the review of DOE Safety Analysis Reports for the main systems to be used in supernatant processing. After most of the cesium has been removed in the Supernatant Treatment System, the LWTS will comentrate the decontaminated supernatant to the proper density for incorporation in cement.

The evaporate will be further decontaminated and released to the environment as a low-level waste stream. During at least the initial phase of operation, the relcase will be through the existing lagoon system and into an on-site stream.

Budget pennitting, a large evaporation system may be installed later to eliminate the liquid discharge. Calculations in the DOE Safety Analysis Report, confirmed by the NRC staff, show that concentrations of all radionuclides at the point of discharge into the stream will be well below Part 20 limits.

Babcock & Wilcox Representatives of Babcock & Wilcox's Pennsylvania Nuclear Service Operations ret with FCSB staff to review the status of activities at their Apollo and Parks Township facilities. B&W reported completion of contaminated soil removal i projects at two locations adjacent to the Apollo site. Other similar projects are in planning.

LOW-LEVEL WASTE MANAGEMENT  :

Low-level Waste i

Meetino With EPA On Mixed Waste LLRB staff will meet with the EPA on Monday, April 18, 1988 to discuss the contents of the products on mixed waste under progress and to establish schedules for their issuance. The products under discussion would include:

(il response to the public coments on the definition guidance; (ii) regulation comparfson on licensing / permitting process; and (iii) joint guidance on  !

sampling and testing.  :

1 Meeting with Vennont Yankee on low-level Waste Disposal On April 13; NRC staff met with representatives from the Vennont Yankee Nuclear Power Corporation. The purpose of the meeting was to discuss the feasibility of developing a low-level waste disposal facility at the Vermont Yankee plant site. Vermont Yankee representatives presented a conceptual

design of an earth mounted concrete bunker facility. The function of the LLW f

facility would be for the disposal of all low-level wastes generated in the

State of Vennont (the Vennont Yankee reactor gegerates about 90% of the State's waste volume which is currently about 10,000 FT annually). NRC staff provided Vermont Yankee with some preliminary views on the types of problems and issues that may be encountered in locating a LLW disposal facility at a nuclear power reactor site.

i SAFEGUARDS Domestic Safeguards Emeroency Preparedness Exercises On April 12, 1988, NMSS, SGTR and IMNS management and staff participated in a simulated safeguards / materials event at an operating fuel fabrication facility. The exercise involved full participation of the Executive Team, Chairman Zech, EDO, NMSS, NRR, RES, and AE0D and simulated response by Region II and licensee. The FBI also participated in the headquarters exercise. In preparation for the Exercise, SGTR staff briefed the Executive Team on April 7,  !

1988, on safeguards physical security programs. NRC and FBI interactions and responsibilities, and safeguards classification issues.

- 3 Transportation Midwestern and Northeastern Regional TRANSRAM Workshops TRANSRAM workshops are sponsored by Department of Transportation (DOT) to provide State and Indian officials an opportunity to meet and discuss regional issues associated with the transportation of radioactive material. The Midwestern workshop was held in Osage Beach, Missouri, April 11-12, 1988, and was attended by representatives from 9 states.

This year, DOT has scheduled the TRANSRAM workshops to coincide with its C0HMED (Cooperative Hazardous Material Enforcement Development) workshops to facilitate state participation. DOT now provides RAM Transportation training at the TRANSRAM workshop. Accordingly, many TRANSRAM participants are state law enforcement officials.

The Osage Beach workshop was comprised of three half-day sessions on overviews of Federal transportation programs and regulations, state presentations on '

their programs and ;ssues, and a summary of DOT inconsistency rulings and emergency response information, respectively. SGTR continues to present a sumary of spent fuel cask safety research, including the Modal Study. The principal issues discussed by participants were similar to those of other workshops: emergency response training for first respondents; response team members comunicating within and among states and with federal agencies; and funding for programs.

Items of Interest Office for Analysis and Evaluation of Operational Data Week Ending April 15, 1988 CRGR The CRGR reviewed four items at Meeting No. 133 on April 13, 1988: (1)a proposed Comission Paper on Key Policy Issues Resulting from NRC Staff Review of DOE-Sponsored Advanced Reactor Concepts, and a proposed Comission Paper on Standardization of Advanced Reactor Designs; (2) a proposed Supplement to NRC Bulletin No. 87-02, "Fastener Testing to Detennine Conformance With Applicable Material Specifications;" (3) a proposed Supplement to NRC Bulletin No. 85-03, "Notor-Operated Valves Comon Mode Failures During Plant Transients Due to Improper Switch Setting;" and (4) a proposed amendment to 10 CFR 50.47(d) to establish more clearly what emergency planning and preparedness requirements are needed for fuel loading and low power operation of nuclear power plants.

The Conunittee deferred action on item (1) until a later date so that additional time could be made available to discuss the Comittee's concerns. The Comittee recommended (1) chat the proposed supplements to NRC Bulletin Nos. 87-02 and 85-03 be issued; and (2) that the proposed amendment to 10 CFR 50.47(d) be forwarded to the Comission and issued for public coment, subject to review by the Office of RES regarding language and the technical basis for lower risk at le!,s than 5% power.

Division of Safety Programs Trends and Patterns Analysis Trends and Patterns staff met with the Director of the Data Systems / Trends Analysis Division, NASA Headquarters to discuss the NASA trends and patterns program. NASA has established a management information center that gathers, tracks and analyzes data on problems, programs and performance related to the space shuttle. This activity embraces a wide range of data, including hazards analysis findings, indicators of schedule pressure, and remaining useful lives for components which has similarities with NRC interests.

NUREG-0090, Vol. 10, No. 3 "Report to Congress on Abnormal Occurrences:

July-September 1987," and NUREG-0090, Vol. 10, No. 4. "Report to Congress on Abnonnal Occurrences: October-December 1987." were both published in late March 1988. Both reports have been forwarded to Congress and released for general distribution.

Reactor Operations Analysis Branch l

The February 1988 Issue of the Quarterly PI Report was placed in the PDR on April 8, 1988.

Division of Operational Assessment Incident Response The IRB staff conducted an exercise involving a threat to the NFS Erwin nuclear fuel facility on April 12, 1988. Chairsan Zech participated along with other members of the Executive Team and representatives of the Federal Bureau of Investigation (FBI). The Chairman was interested in the FBI interface and had useful discussions with the FBI representatives. A number of lessons were identified for action and will be fonnalized.

On April 13-14, the IRB staff conducted an assessment of Region II's implemen-tation of the Incident Response program. .

On April 13-14, IRB staff met with the Technical Training Center (TTC), RES, and Brookhaven National Laboratory in Chattanooga, Tennessee to discuss the incorporation of severe accident insights and phenomonology descriptions into the NRC emergency response team training to be provided by the TTC. The basic scope of the required training was agreed to and a schedule for development was proposed. Further RES assistance is needed and a request for this effort is under development.

Diagnostic Evaluation and Incident Investigation -

The Director DOA, Chief, DEIIB, and the DEIIB staff, with the input and assistance of NRR and the Region II staff, developed an evaluation plan to assess the ENERCON Independent Management Appraisal for Turkey Point and Florida Power and Light.

The plan involves a team effort among AE00, NRR, and Region II staff members '

with team leadership provided by AE00. The objectives of the evaluation include:

assessment of the quality and completeness of the ENERCON evaluation in identifying the remaining problems at Turkey Point, the need for an AE00 diagnostic evaluation and documentation of team findings and conclusions. The first meeting among the team members and DE!!B staff involved in the review was conducted on April 15.

INTERNATIONAL PROGRAMS Foreign Visitors On Tuesday Mr. Wolfgang Schwarzer. Executive Secretary of the West German Nuclear Safety Standards Comission (KTA), and Mr. Josef Pfaffelhuber, KTA, (recently retired head of the Nuclear Safety Directorate of the Federal Ministry for Environment, Nature Conservation and Nuclesr Safety-BMU),

visited NRC. The visitors were here to discuss various topics related to US regulatory practices in preparation for the November 7-10 "International Symposium on Regulatory Practices and Safety Standards for Nuclear Powe-Plants," which will be held in Munich, FRG. This symposium is the first major attempt by the IAEA, in conjunction with the OECD Nuclear Energy Agency and the German government (acting as host), to draw on the more cooperative international attitudes in the post-Chernobyl era to identify, explain, and discuss national regulatory approaches and practices. In their effort to collect infomation from other countries, Messrs. Schwarzer and Pfaffelhuber are also tentatively considering scheduling trips to France, the Soviet Union, and Switzerland. At NRC, the visitors met with members of RES, NRR, OGC, IP and OE.

l STATE, LOCAL AND INDIAN TRIBE PROGRAMS Nebraska Legislatur,e Passes LLW Legislation The Nebraska Legislature has approved and sent to Governor Kay Orr a bill (Legislative Bill 1092) that contains the following provisions related to the State's low-level radioactive waste activities:

1. Requires a disposal site developer (US Ecology) to locate the facility "to the extent possible...where community support is evident."
2. Requires the formation of nine-member local monitoring committees in the vicinity of each proposed site and a permanent monitoring committee in the vicinity of the selected site.
3. Prohibits the disposal of waste from reactor decommissioning at a Nebraska disposal facility "until the department has determined that such facility is designed to safely store or dispose of such waste."
4. Requires Class C waste to be stored or disposed of separately in containers "which can be easily monitored and retrieved."
5. Provides a mechanism fc.r property owners in the vicinity of the facility to be compensated for property devaluation that occurs as the result of the construction and operation of the facility.

' The Governor is expected to sign the bill. Nebraska was selected in December 1987 as the host State for the Contral Interstate Waste Compact. The other States in the Compact are Arkansas, Kansas, Louisiana, and Oklahoma.

Meeting with Illinois Commerce Commission  :

On April 13, 1988, Roland Lichus, Region III Chief of State and Government Affairs; Ed Greenman, Director of the Division of Reactor Projects in Region III; Dan Muller, Project Director of PDIII-2 in NRR; and Debbie Jackson, Project Engineer in NRR, met with members of the Illincis Connerce Commission to discuss areas of mutual int.srest. Among the topics discussed were the NRC reorganization, Braidwood licensing issues, and the SALP process.

A new method of distributing the weekly vacanc) announcement to the regions was initiated. Tne regions will now receive tie weekly announcement the same day that it goes to the printer. This should s?eed-up receipt by regional personnel and resident inspectors by approximately five working days.

An Order Continuing Suspension of License and Order to show Cause why License Should not be Revoked and Notice of Violation was issued on April 11, 1988 to Finlay Testing Laboratories Inc., Aiea Hawaii. The Order was based on additional significant transportation violations revealed following an investigation. (EN 88-30)

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 was issued on April 12, 1988 to Northeast Nuclear Energy Company (Millstone Unit 3). The action was based on the failure to have the required

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $100,000 was issued on April 13, 1988 to Arizona Nuclear Power Project (Palo Verde Units 1 and 2). The action was based on violations of requirements in two different plant disciplines. In the first case improper engineering

' and review resulted in an inoperable turbine driven Auxiliary Feedwater Pump on each unit. In the second case operational problems including failure to follow procedures and inadecuate verification resulted in, on separate occasions, an inoperable Auxiliary Feecwater Pump on Unit 2, an inopert:ble High Pressure Injection Pump on Unit 1, and an inadvertent safety injection on Unit 2, (EN88-29)

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $2,500 was issued on April 13, 1988 to Veterans Administration Medical

  • Center, Wichita, Kansas. The action was based on the licensee not having an authorized physician to use and supervise licensed material and the physician who did use material was not qualified. In addition, the licensee did not have an approved radiation safety officer and did not conduct required training.

Civil Penalty Paid Virginia Electric and Power Company (North Anna Unit 2) paid the proposed civil penalty in the amount of $100,000. The action was based on a failure to place inoperable steam flow channels in trip as required by the Technical Specifications. (EA 87-246)

Consolidation at One White Flint North Completed A significant milestone was reached on April 11, when the Comissioners, their staffs, and the other offices previously located at 1717 H Street, NW, moved to One White Flint North. That building is now completely occupied and the first phase of NRC's consolidation process is complete. When the move to the 17th and 18th floors was accomplished over the weekend of April 8 - 10, it marked the end of the four-month process during which more than 1,400 NRC employees have been transferred to the new headquarters building.

Approval of Second Building Recommended Phase 2 of NRC's consolidation process took a giant step forward on April 14 when the Maryland National Park and Planning Comission (MNCPPC) recomended that the Montgomery County Council approve the plan to build a second office building for NRC on the White Flint site. The recommendation was based on NRC's fulfilling two conditions: (a) the peak-hour automobile trip generation rate from the two buildings must not exceed 640 (the number previously approved for the project when the developers were planning on a hotel-conference center for the second stage of the developtrent); and (b) the population of the two buildings combined will not exceed 2,450 persons, unless NRC can demonstrate that a greater number will not cause the trip generation rate to exceed 640.

The next steps in the decision process are a review by the County Council of the Comission's recomendation, and then an application to the MNCPPC for approval of the developers' subdivision plan for the site.

New York Times to Report on OWFN Problems A reporter for The New York Tirnes interviewed Michael Springer. Director of the Office of Consolidation, concerning several problems at One White Flint North. Mr. Springer answered his questions concerning the lead contamination

' in the drinking water, allegations that an "Executive Club" was to be funded by the Employees Recreation Association, and whether it was true. that persons who used the emergency telephones in the elevators to report problems were answered by an operator in Connecticut. The article is scheduled for publica-tion about April 21.
