Gentlemen:

SUBJECT: NOTICE OF VIOLATION

(NRC INSPECTION REPORT NOS. 50-424/88-14 AND 50-425/88-11)

This refers to the Nuclear _ Regulatory Commission (NRC) inspection conducted by

A. Tillman on February 22-26, 1988. The inspection included a review of

activities authorized for your Vogtle facility. At the conclusion of the

inspection, the findings were discussed with those members of your staff

identified in the enclosed inspection report.

Areas examined during the inspection are identified in the report. Within

these areas, the inspection consisted of selective examinations of procedures

and representative records, interviews with personnel, and observation of

activities in progress.

The inspection findings indicate that certain activities appeared to violate

NRC requirements. The violations, references to pertinent requirements, and

, elements to be included in your response are described in the enclosed Notice

'

of Violation.

j In addition to the need for corrective action regarding the specific matters

, identified in the enclosed Notice, we are concerned about the implementation of

l your security program that permitted this situation to continue. Consequently,

l your response should describe those particular actions taken or planned to

i improve the effectiveness of your program.

The violation described in the enclosed Notice is similar to a violat.on

contained in the Notice sent to you by our letter dated September 4, 1987.

because "similar violations", as described in the NRC Enforcement Policy, are

of significant concern to the NRC, please give particular attention in your

i

l response to the identification of the root cause of this problem and your

failure to complete the corrective action to prevent recurrence, as stated in

your October 21, 1987, letter to the NRC Enforcement Action Letter EA 87-100,

dated September 4, 1987. Specifically, concerning your commitment to install

cipher pads at the entry turnstiles.

In accordance with 10 CFR 2.790(d) and 10 CFR 73.21, safeguards activities and

security measures are exempt from public disclosure. Therefore, the en' closures

to this letter with the exception of the report cover page, which presents a

nonexempt summary,.will not be placed in the NRC Public Document Room.

The responses directed by this letter and its erclosures are not subject.to the

clearance procedures of the Office of Management and Budget as required by the

Paperwork Reduction Act of 1980, Pub. L. No.96-511.
