REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE By application and affidavit dated May 18, 1988 from Mr. T. C. Feigenbaum, New Hampshire Yankee (NHY) submitted Figure 2-2 of the FEMA-REP-10 Design Report and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. Mr. Feigenbaum stated that Figure 2-2 of the FEMA-REP-10 Design Report, which identifies siren locations, when combined with other infoncation (presumably information contained in the FEMA-REP-10 Design

Report) would pemit the identification of certain persons and organizations who agreed te supply services, resources and facilities to support the Seabrook Plan for Massachusetts Comunities (Plan). Therefore, Mr. Feigenbaum stated the infomation should be considered exempt from mandatory public disclosure for the following reasons: Such disclosure would constitute an unwarranted invasion of personal privacy and could undermine efficient implementation of the Plan in the unlikely event of a real emergency at the Seabrook Station. He also stated that this information is of a type customarily held in confidence by applicants.

The application and the material submitted to be withheld from public disclosure were reviewed against the requirements and criteria of 10 CFR 2.790 and, considering Mr. Feigenbaum's statements, have determined that the submitted infomation sought to be withheld contains proprietary commercial information.

Therefore, Figure 2-2 of the FEMA-REP-10 Design Report marked as p oprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b (5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of pt:rsons properly and directly concerned to inspect the docurrents. If the need arises, we may send copies of this infomation to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary infomation, b

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC, You should also understand that NRC may have cause to review this detennination in the future, such as, if the scope of a Freedom of Information Act reouest includes your infonnation.
