SUBJECT:
TEMPORARY WAIVER OF COMPLIANCE - MCGUIRE NUCLEAR STATION, UtllTS 1 and 2 (TACS 68727/68728)
By telephone call on July 15, 1988, and by your letters of July 15 and 19,1988, you informed the NRC staff that it is not possible to demonstrate com liance with the current McGuire Technical Specification (TS) 4.8.1.1.2.e.6)c. This surveillance TS requires all but three automatic diesel generator (DG trips to be automatically bypassed during simulation of a loss-of-offsite power in conjunction with an engineered safety features actuation test signal.
This TS can not be met as presently written because, in fact, there are four DG trips not automatically bypassed in the design rather than three. Similarly, there are two breaker trips not automatically bypassed rather than the one presently recognized in the TS.
You requested that the TS be corrected on an emergency basis to avoid all diesels being declared inoperable and the attendant requirement for shutdown and extended refueling outage for McGuire Units 1 and 2 respectively.
We have reviewed your evaluation and the justification provided in your letter regarding the DG operability. We agree that the time overcurrent diesel generator protective trip and the generator differential breaker trip should not be automatically bypassed when conducting the above cited surveillance test. This letter confirms the verbal granting of a temporary waiver of compliance for the above TS.
This waiver of compliance will be in effect through July 22, 1988, while we complete the processing of your emergency TS change request.
The potential violation of this TS associated with prior testing since February 1,1985, is not affected by this flRC waiver. Whether enforcement action is appropriate will be separately considered.
