By memorandum from you to me of January l',1981, you cor:rnented on a) you disagreed with the management position on the amount of detail a rule for fire protection requirements for plants 1icensed to operate after January 1, 1979 should contain; and b) the specified regulations be cade effective as soon as possible after the SRP Section 9.5-1 is revised.

The present management recomendation on t'..e new rule is enunciated in SECY-80-546, " Fire Protection Rule for Future Plants" dated Dece :er 23, In my opinion,.the position you rer.omend on the amount cf detail 1930.

and the one in SECY-80-546 are consistent, therefore, it should net be considered a differing professional opinion.

As to the date the fire protection rule should be made applicable, I cannot agree that the revised SRP Section D.5-1 will not require cor.sicerable work i.et me quote from SECY-S;-545:

before it can be issued as a new rule.

Recommendation:

It is recorrnended that the Comnission adopt Alternative 3 and direct the staff to issue a fire protection rule for public cocrent by July 1, 1982. This date is consistent with the availabie staff resources, considering that the limited staff fire protection expertise can be bet:rr used in expeditiously upgrading existing fa;ilities.

It should be noted that new applications ate not expected to be numerous in the near future.
