ACE FEDERAL PROTEST AGAINST HERITAGE REPORTING CONTRACT On August 5,1987 I received the enclosed package concerning the Ace Federal Reporting protest against a proposed contract award to Heritage Reporting Corporation from Leigh Chase.

Leigh had received it from Cindy Fleenor. 0.C.

I discussed the issue with Cindy Fleenor on August 7,1987 and she advised me that she had a written determination from the Small Business Administration that Heritage Reporting Corporation was a separate business entity from Acme Reporting Company.

This determination was in response to an ACE federal protest to SBA on the same issue.

I also had a discussion with Mr. Mark Borst of the Defense Investigative Service who advised me that DIS has no ongoiag investigation of Heritage Reporting Corporation or any of its Corporate Officers. A number of fonner Acme personnel are now employed by Heritage, but the personnel from Acme who are under inves-(

tigation ar*. not employed by Heritage.

I advised Cindy Fleenor, on August 7,1987, that under the above circumstances, l.

I did not feel there was sufficient security justification for delay or inter-ference with contract award to Heritage and that SEC would not object to making the award.

On August 11, 1985 I was told by Raymond J. Brady that Edward Halman had infonned him that DIS had denied facility approval to Heritage Reporting Corp.

I again contacted Mr. Mark Borst of DIS who advised that there was no pending request for facility approval for Heritage; therefore, there could not be a denial.

He indicated that the Ace Attorne again on 8/10/87 and had told him (Borsi) y, Mr. Henry, had contacted him that NRC had said that DIS had said Acme and Heritage were two separate companies.

It appears that Mr. Henry is attempting to create confusion by calling back and forth between NRC and DIS and purporting to relay what the agencies are saying in a manner suited to his advantage, y
