Dear Mr. Stetz:
SUBJECT: ROUTINE RESIDENT INSPECTION AT DAVIS-BESSE (50-346/94013(DRP))
This refers to the inspection conducted by S. Stasek, C. Lipa, and D. Shepard
of this office on October 25, 1994, through December 8, 1994. The inspection
included a review of activities authorized for your Davis-Besse Nuclear Power
Station. At the conclusion of the inspection, the findings were discussed
with those members of your staff identified in the enclosed report.
Areas examined during the inspection are identified in the report. Within
these areas, the inspection consisted of selective examinations of procedures

and representative records, interviews with personnel, and observation of
activities in progress.

Based on the results of this inspection, certain of your activities appeared

to be in violation of NRC requirements, as specified in the enclosed Notice of
Violation (Notice). Tha violation is of particular concern because it

involved wcaknesses in yo9r implementation of foreign material exclusion (FME)
[
controls around the reacte cavity and is the third such violation related to

FME issued since August 1994 (reference NRC inspection reports 50-346/94006

and 50-346/Nell). A management meeting with you and members of your staff
II
was held in the Region III office on November 14, 1994, to discuss, in part,
i}LlI
refueling outage related issues including those involving FME.

Although 10 CFR 2.201 would normally require you to submit a written statement
of explanation to this office within 30 days of the date of this letter
transmitting the enclosed Notice, we note that you now appear to be
impleenting sufficient corrective actions to prevent further recurrence.
Those actions were reviewed during this inspection as documented in the
j
enclosed report. Therefore, no response with respect to this matter is
required at this time.
In addition, certain other of your activities also appeared to be in violation
of NRC requirements. Specifically, a spent fuel pool (SFP) gate was lifted
over the SFP without an operable emergency ventilation system in violation of

your Technical Specifications. However, as described in the enclosed
inspection report, the violation was identified by licensee personnel,
ft
adequate corrective actions were taken, and appropriate notifications made.

Therefore, this violation will not be subject to enforcement action because

your efforts in identifying and correcting the violation met the criteria

Procedures for NRC Enforcement Actions," (Enforcement Policy,10 CFR Part 2,
Appendix C).
