ENCLOSURE 1 NOTICE OF VIOLATION Carolina Power and Light Company Docket Nos. 50-325 and 50-324 Brunswick 1 and 2 License Nos. OPR-71 and DPR-62 During the Nuclear Regulatory Commission (NRC) inspection conducted on December 1-31, 1987, a violation of NRC requirements was identified. In accordance with the "General Statement of Policy and Procedure for NRC Enforce-ment Actions," 10 CFR Part 2, Appendix C (1987), the violation is listed below:

Technical Specifications (TS) 3.6.3 and 3.6.1.1 collectively require, in certain circumstances, the use of a deactivated automatic valve for the purpcse of maintaining containment integrity. Specifically:

a. TS 3.6.3 requires that with one or more inoperable containment isolation valves, operation may continue provided that at least one isolation valve is maintained operable in each affected penetration that is open and each affected penetration line is isolated within 8 hours9.259259e-5 days <br />0.00222 hours <br />1.322751e-5 weeks <br />3.044e-6 months <br /> by use of at least one deactivated automatic valve secured in the isolation position or isolated with one closed manual valve or blind flange.

Contrary to the above, the licensee failed, on two occasions, to isolate the affected penetration line within 8 hours9.259259e-5 days <br />0.00222 hours <br />1.322751e-5 weeks <br />3.044e-6 months <br /> in that penetra-tion lines associated with inoperable containment isolation valves were secured with valves that were not deactivated. Automatic valves 1-CAC-V50 and 1-832-F020 were only red-tagged closed between June 16, and September 22, 1987, respectively and December 8, 1987. The valve switches were still capable of operating the valves.

b. TS 3.6.1.1 requires that primary containment integrity shall be maintained. TS defines primary containment integrity to exist when all penetrations required to be closed during accident conditions are either capable of being closed by an operable containment automatic isolation valve system or closed by at least one manual valve, blind flange or deactivated automatic valve secured in its closed position.

Contrary to the above, containment integrity was inadequately maintained in that a penetration was closed by automatic valve 2-RXS-SV-4189 without being properly deactivated between October 6 and December 23, 1987. The valve was closed and red-tagged with the switch still capable of operating the valve.

This is a Severity Level IV violation (Supplement I).

OPR-71 and DPR-62 Pursuant to the provisions of 10 CFR 2.201, Carolina Power and Light Company is hereby required to submit to this office within thirty days of the date of the letter transmitting this Notice, a written statement or explanation in reply, including (for each violation): (1) admission or denial of the violation,(2) the reasons for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
