SUBJECT:

SECY-94-176 - ISSUANCE OF PROPOSED RULEMAKING PACKAGE ON SHUTDOWN AND LOW-POWER OPERATIONS FOR PUBLIC COMMENT The Commission (with all Commissioners agreeing) has approved publication of the proposed rule for public comment with the following changes:

1) The staff should plan to specifically reassess the backfit analysis conclusion for the BWRs and add a statement to that effect as shown in the attachment.
2) The applicability of the rule should be clarified to exclude those plants that have defueled for final shutdown, but still retain an operating license (i.e.,

those that are preparing for decommissioning).

3) The wording of (c) (1) should be changed to read: "Take measures to ensure that uncontrolled changes in reactivity ..." The regulatory guide can provide any needed details on what " measures" a licensee might take.

In conjunction with staff review and evaluation of public comments and prior to submission of the final rule, the Commission asked that the staff reconsider certain portions of the regulatory analysis, including: (1) clarifying the reasoning on why BWRs should be required to implement Improvement A, SECY NOTE: THIS SRM, SECY-94-176, AND THE VOTE SHEETS OF ALL COMISS.ONERS WILL BE MADE PUBLICLY AVAILABLE 10 WORKING DAYS FROM THE DATE OF THIS SRM.

6 despite marginal cost-effectiveness; (2) some analysis of the avoided near-term high dose to occupational personnel in assessing the occupational exposure (V2) factor; and (3) acknowledging the potential impact on outage schedule that these regulatory requirements could cause for some licensees.
