STATE PROGRAMS CONCURRENCE AND COMMENTS ON WITHDRAWAL OF PROPOSED RULEMAKING TO ESTABLISH PROCEDURES AND CRITERIA FOR ON-SITE STORAGE OF LOW-LEVEL RADIOACTIVE WASTE AFTER JANUARY 1, 1996 The Office of State Programs concurs in the Draft Commission paper on withdrawal of the proposed rulemaking to establish procedures and criteria for on-site storage of low-level radioactive waste after January 1, 1996.
To improve the clarity of the pape.r, staff recommends the following:
- 1. Attachment 1, Item B.2., p. 3. NRC does not have a policy.
regarding on-site storage of LLW, but rather a position.
Therefore, the wording in the sentences needs to read as follows: "The incorporation in its regulations of NRC's long-standing position concerning the on-site storage of LLW..."
- 2. Attachment 1, Item F.1., p. 16. Because the meaning of compatibility divisions is not well known, consideration should be given to adding short parenthetical descriptions for them.
- 3. Attachment 1, Item J.7., p. 23. The discussion on the approximate cost to licensees does not give a final estimate as claimed in the Regulatory Analysis. The commenter claims
$50 million. What is the revised estimate to counter the
$50 million?
- 4. Attachment 1, Item K.1., p. 24. The NRC formally withdrew both its advance notice of proposed rulemaking for BRC; and its BRC policy statements. See 58 FRF 44610 and 44620 (August 24, 1993). These should be noted in the response.
