The Office of Investigations determined that there was insufficient evidence to substantiate the allegation of discrimination. We plan no further action with regard to this matter. SYNOPSIS On July 9,1996, the Office of Investigations, U.S. Nuclear Regulatory Commission. Region II, initiated this investigation in order to determine if a '

security training officer, employed by SBI Nuclear, Inc. (SBI), at Florida  !

Power Corporation's (FPC) Crystal River Nuclear Plant had been discriminated '

against by SBI or FPC supervision or management for expressing concerns I regarding the fitness for duty of the FPC manager of Security.

The security training officer alleged that in December 1995, SBI terminated l his employment by laying him off, and did not consider him for re-employment, I because he had raised concerns to both SBI and FPC personnel regarding I aberrant behavior on the part of the FPC manager of Security. The officer alleged that his first complaint was filed in July 1994, immediately following an altercation between him and the FPC security manager. He alleged that, a l year later, in July 1995, he resurfaced his complaint to FPC, having not been apprised of ar:y action being taken on his earlier complaint.

Based upon the evidence collected during the course of this investigation, it is concluded that this allegation of discrimination, as defined in 10 CFR l 50.7, entitled Employee Protection, is unsubstantiated.
