Combined Investigation 50-443/78-12 and 50-444/78-12

This refers to the investigation conducted by Messrs. R. H. Smith and S.

A. Folsom of this office from July 26 to August 11, 1978, relative to

complaints received by the NRC regarding the Nuclear Regulatory Com-

mission Order on June 30, 1978, which suspended the construction permits

for Seabrook Station Units 1 and 2 effective July 21, 1978.

This also

refers to the telephone discussion of our findings between Mr. R. H.

Smith and Mr. J. H. Herrin of your staff on August 8,1978.

Areas examined during this investigation are described in the Office of

Inspection and Enforcement Investigation Report which is enclosed with

this letter.

Within these areas, the investigation consisted of selective

examinations of procedures and representative records, interviews with

personne'

and observations by the investigators.

Within the scope of this investigation, no items of noncompliance were

observed.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part

j

2. Title 10, Code of Federal Regulations, a copy of this letter and the

'

enclosed investigation report will be placed in the NRC's Public Document

Room.

If this report contains any information that you (or your contractor)

believe to be proprietary, it is necessary that you make a written

application within 20 days to this office to withhold such information

from public disclosure. Any such application must be accomparied by an

affidavit executed by the owner of the information, which identifies the

document or part sought to be withheld, and which contains a statement

of reasons which addresses with specificity the items which will be

considered by the Comission as listed in subparagraph (b)(4) of Section

2.790.
