1. PROPOSEDEXEMPTION

Pursuantto10CFR73.5,SpecificExemptions,and10CFR72.7,SpecificExemptions,Portland GeneralElectric(PGE)requestsatemporaryexemptionfrom10CFR73,AppendixB,SectionI.E, PhysicalandMedicalRequalification,fortheTrojanIndependentSpentFuelStorageInstallation (ISFSI).

Withoutanexemptioninplace,asof10:00a.m.onJune1,2020,certainTrojanISFSIpersonnel willbeunabletocomplywiththemedicalrequalificationrequirementsin10CFR73, AppendixB,SectionI.Easdescribedbelow.

Thepurposeof10CFR73,AppendixBistoprovidegeneralcriteriathatspecifysecurity personnelqualificationrequirementstoensurethatthoseindividualsresponsibleforsecurity areproperlyequippedandqualifiedtoexecutethejobdutiesprescribedforthem.Thegeneral criteriaincludedin10CFR73,AppendixBestablishrequirementsfortheselection,training, equipping,testing,andqualificationofindividualswhowillberesponsibleforprotectingspecial nuclearmaterials,nuclearfacilities,andnuclearshipments.Thisexemptionrequestpertainsto therequalificationfrequencyrequirementsincludedinthespecificsectionof10CFR73, AppendixBdescribedbelow:

PGEmaintainsaTrainingandQualification(T&Q)Programforthesecurityorganizationto implementtherequirementsof10CFR73,AppendixB,asapplicable.Asaresultofthecurrent limitationssurroundingthepandemicassociatedwiththeCoronavirusDisease2019 (COVID19),thereislimitedaccesstopublicfacilities,stateandfederalshelterinplaceorders havebeenissued,andadditionalrisksassociatedwithsocialinteractionsarepresentthat challengePGEsabilitytocomplywiththephysicalandmedicalrequalificationrequirements includedintheT&QProgram.

DuetotheimpactsoftheCOVID19outbreak,thequalifiedmedicalproviderfortheTrojan ISFSIisnotseeingpatientsforroutinevisitssuchasphysicals.Also,requiringPGEpersonnelto enteramedicalfacilitywouldimposeunduepandemicrelatedhealthrisksfortheemployee, employee'sfamily,medicalstaff,andcoworkers.Inordertomeettherequalification requirementsoftheTrojanISFSIT&QProgram,facetofaceappointmentsarenecessary.

Basedontheinformationabove,PGEisrequestingatemporaryexemptionfromthe requirementsof10CFR73,AppendixB,SectionI.E,specificallyforthe12monthphysical requalificationrequirementperTrojanIndependentSpentFuelStorageInstallationSecurity Plan,PGE1073,AppendixC,SectionC.1.2(Reference6.7).

PGEisrequestingthatthedurationofthetemporaryexemptionbetiedtotheendofthe pandemicassociatedwiththeCOVID19outbreak.Theendofthepandemicwouldbesignified bysuspensionoftheemergencydeclarationatthelocal,state,andfederallevel.Basedonthe informationabove,PGEisrequestingthefollowingtemporaryexemption:

Temporary Exemption Duration 10 CFR Part 73, Appendix B, Section I.E.

Physical requalification - At least every 12 months, central alarm station operators shall be required to meet the physical requirements of B.1.b of this section, and guards, armed response personnel, and armed escorts shall be required to meet the physical requirements of paragraphs B.1.b (1) and (2), and C of this section.

PGE will complete the physical requalification at the first reasonable opportunity, and no later than 6 months1 following suspension of the emergency declaration at the local, state, and federal level.

2. BACKGROUND

OnJanuary31,2020,theUnitedStatesDepartmentofHealthandHumanServicesdeclareda publichealthemergencyfortheUnitedStatestoaidthenation'shealthcarecommunityin respondingtotheCOVID19outbreak(Reference6.5).Subsequenttotheabovedeclaration, thefollowingadditionaleventsrelatedtotheCOVID19outbreakhavetakenplace:

March8,2020:OregonGovernordeclaredaStateofEmergency(Reference6.1).

March11,2020:TheWorldHealthOrganizationdeclaredtheCOVID19outbreaka pandemic(Reference6.6).

March13,2020:ColumbiaCountyBoardofCommissionerssignedResolution252020 IntheMatterofDeclaringaLocalStateofEmergencyDuetoCOVID19(Coronavirus)

(Reference6.3).

March23,2020:OregonGovernorKateBrownissuedExecutiveOrder2012,effective immediatelyuntilfurthernotice.Thisisastatewideorder,whichorderedallindividuals livingintheStateofOregontostayhomeorattheirplaceofresidenceexceptfor essentialneeds(Reference6.2).

May1,2020:OregonGovernorKateBrownissuedExecutiveOrderNo.2024extending theCOVID19declarationofemergency(ExecutiveOrderNo.2003)foranadditional 60days,throughJuly6,2020(Reference6.8).

AsaresultofthecurrentlimitationssurroundingthepandemicassociatedwiththeCOVID19 outbreakthereislimitedaccesstopublicfacilities,therearestateandfederalshelterinplace orders,andthereareadditionalrisksassociatedwithsocialinteractionsthatchallengePGE's abilitytocomplywiththephysicalandmedicalrequalificationrequirementsincludedinthe T&QProgram.Therefore,PGEisrequestingatemporaryexemptionasdescribedinSection1 forthesecurityorganizationattheTrojanISFSI,locatedinColumbiaCounty,Oregon.

3. BASISFOREXEMPTION

Thespecificconditionsforgrantinganexemptionfromregulationsin10CFR73aresetforthin 10CFR73.5,SpecificExemptions.Inaccordancewith10CFR73.5,theCommissionmay,upon applicationofanyinterestedpersonoruponitsowninitiative,grantsuchexemptionsfromthe requirementsoftheregulationsinthispartasitdeterminesareauthorizedbylawandwillnot endangerlifeorpropertyorthecommondefenseandsecurity,andareotherwiseinthepublic interest.Asdiscussedbelow,thistemporaryexemptionrequestsatisfiestheprovisionsof 10CFR73.5.

3.1 TheTemporaryExemptionRequestisAuthorizedbyLaw

TheNRC'sauthoritytograntanexemptionfromitsregulationsin10CFR73isestablished bylawasdiscussedin10CFR73.5.Therefore,grantinganexemptionisexplicitly authorizedbytheNRC'sregulations.

3.2 TheTemporaryExemptionRequestWillNotEndangerLifeorPropertyortheCommon DefenseandSecurity

Thistemporaryexemptionallowsanextensionoftherequalificationfrequencyfor medicalphysicalsandwillnotendangerlifeorpropertyorthecommondefenseand security.Individualswithinthesecurityorganizationthatrequirephysicalandmedical requalificationshaveundergonephysicalandmedicalrequalificationsinaccordancewith theTrojanISFSIT&QProgramand10CFR73,AppendixB.Theindividualsthatthis exemptionappliestohaveproventheirphysicalabilitypriortoinitialassignmentand duringanysubsequentphysicalandmedicalrequalifications.Physicalandmedical requalificationrequirementsthatareextendedwillbeenteredintotheTrojanISFSI correctiveactionprogrampriortotheexpirationdatetoensuretheyaretrackedfor completionatalaterdate.Inaddition,inaccordancewithcurrentprocedures,PGEwill continuetoensurethatanyindividualwithinthesecurityorganizationwhoselfdeclares theirinabilitytoperformtheircurrentassignedtaskswillberemovedfromduty.This temporaryexemptionwillcontributetothecommongoalofprotectingtheTrojanISFSI facilitybypreservingthehealthandsafetyofthecurrentqualifiedsecurityforce.

Therefore,thistemporaryexemptionrequestwillnotendangerlifeorpropertyorthe commondefenseandsecurity.

3.3 TheTemporaryExemptionRequestisinthePublicInterest

Atemporaryexemptiontoallowanextensionoftherequalificationfrequencyformedical physicalsisintheinterestofthepublic.AsdescribedinReferences6.2and6.3,boththe ColumbiaCountyBoardofCommissionersandtheGovernorofOregonhaveissued shelterinplaceorderstoprotectpublichealthandsafety.Inaddition,theCDC recommendsavoidingclosecontact(withinabout6feet)byputtingdistancebetween individuals(Reference6.4).Theseordersandrecommendationshaveacommongoalof limitingsocialcontactinordertodisruptthespreadofthevirus.

RequiringPGEpersonneltoenteranytypeofpublicfacilityorengageinclosesocial interactionsunderthecurrentconditionsimposesadditionalhealthrisksforthe employee,theemployee'sfamily,publicfacilitystaff,andcoworkersduetotheCOVID19 outbreak.Regardingmedicalfacilities,theOregonGovernor'sExecutiveOrderNo.2012 states,"Iorderedthepostponementofnonurgenthealthcareprocedures,inorderto

conservepersonalprotectiveequipmentandhospitalbedsforthestatesCOVID19 emergencyresponseefforts.IalsodirectedtheOregonHealthAuthoritytoprovide guidanceregardinglimitationsandscreeningforvisitorstohospitalsandambulatory surgicalcenters"(Reference6.2).Inaddition,theCenterforDiseaseControlstatesthat thebestwaytopreventillnessistoavoidbeingexposedtothevirus(Reference6.4).

Whileprecautionscanbetaken,eachadditionalinteractionamongindividualsincreases theriskofspreadingCOVID19.Therefore,thistemporaryexemptionrequestisinthe interestofthepublic.

4. ENVIRONMENTALASSESSMENT

Pursuantto10CFR51.22(c)(25),anexemptionfromNRCregulationsissubjecttoacategorical exclusionfromthepreparationofanenvironmentalassessmentoranenvironmentalimpact statementif:(i)thereisnosignificanthazardsconsideration;(ii)thereisnosignificantchange inthetypesorsignificantincreaseintheamountsofanyeffluentsthatmaybereleasedoffsite; (iii)thereisnosignificantincreaseinindividualorcumulativepublicoroccupationalradiation exposure;(iv)thereisnosignificantconstructionimpact;(v)thereisnosignificantincreasein thepotentialfororconsequencesfromradiologicalaccidents;and(vi)therequirementsfrom whichanexemptionissoughtinvolve:(E)Education,training,experience,qualification, requalificationorotheremploymentsuitabilityrequirements.

Asdemonstratedbelow,eachoftheseprovisionsin10CFR51.22(c)(25)issatisfiedbythis exemptionrequest.Therefore,pursuantto10CFR51.22(b),noenvironmentalimpact statementorenvironmentalassessmentneedbepreparedinconnectionwiththeproposed exemptions.

4.1 Thistemporaryexemptiondoesnotinvolveasignificanthazardsconsideration.

Asprovidedin10CFR50.92,anactioninvolvesasignificanthazardsconsiderationifit would:(1)Involveasignificantincreaseintheprobabilityorconsequencesofanaccident previouslyevaluated;or(2)Createthepossibilityofanewordifferentkindofaccident fromanyaccidentpreviouslyevaluated;or(3)Involveasignificantreductioninamargin ofsafety.Asdemonstratedbelow,noneofthesecriteriaapplytothistemporary exemption.

Thisproposedtemporaryexemptionwouldextendtherequalificationfrequencyfor medicalphysicalsfortheapplicableindividualswithinthesecurityorganizationatthe TrojanISFSI.Thistemporaryexemptiondoesnotinvolveanyphysicalchangeinthe facilityorintheproceduresgoverningoperationofthefacilityanddoesnotalterthe designbasis.Therefore,thistemporaryexemptiondoesnotinvolveanincreaseinthe probabilityorconsequencesofanaccident,createthepossibilityofanewordifferent kindofaccident,orinvolveareductioninamarginofsafety.

4.2 Thistemporaryexemptiondoesnotinvolveasignificantchangeinthetypesorsignificant increaseintheamountsofanyeffluentsthatmaybereleasedoffsite.

Thistemporaryexemptiondoesnotinvolveanyphysicalchangeinthefacilityorinthe proceduresgoverningoperationofthefacility.Therefore,thistemporaryexemptiondoes notinvolveasignificantchangeinthetypesorsignificantincreaseintheamountsofany effluentsthatmaybereleasedoffsite.

4.3 Thistemporaryexemptiondoesnotinvolveasignificantincreaseinindividualor cumulativepublicoroccupationalradiationexposure.

Thistemporaryexemptiondoesnotinvolveanyphysicalchangeinthefacilityorinthe proceduresgoverningoperationofthefacility.Therefore,thistemporaryexemptiondoes notinvolveasignificantincreaseinindividualorcumulativepublicoroccupational radiationexposure.

4.4 Thistemporaryexemptiondoesnotinvolveasignificantconstructionimpact.

Thistemporaryexemptiondoesnotinvolveanyphysicalchangeinthefacility.Therefore, thistemporaryexemptiondoesnotinvolveasignificantconstructionimpact.

4.5 Thistemporaryexemptiondoesnotinvolveasignificantincreaseinthepotentialforor consequencesfromradiologicalaccidents.

Thistemporaryexemptiondoesnotinvolveanyphysicalchangeinthefacilityorinthe proceduresgoverningoperationofthefacility.Therefore,thistemporaryexemptiondoes notinvolveasignificantincreaseinthepotentialfororconsequencesfromradiological accidents.

4.6 Therequirementfromwhichthistemporaryexemptionissoughtinvolvesphysicaland medicalrequalificationemploymentsuitabilityrequirements.

Thistemporaryexemptionpertainstoextendingthefrequencyofrequalification associatedwithmedicalphysicalsrequiredby10CFRPart73,AppendixB.Therefore,the requestinvolvestheactivitiesdescribedin10CFR51.22(c)(25)(vi)(E).

CONCLUSION

Pursuanttotheprovisionsof10CFR73.5,PGEisrequestingatemporaryexemptionfrom 10CFR73,AppendixB,SectionI.EfortheTrojanISFSI.Basedontheconsiderationsdiscussed above,therequestedtemporaryexemptionisauthorizedbylawandwillnotendangerlifeor propertyorthecommondefenseandsecurityandareotherwiseinthepublicinterest.
