The conference opened with the participants introducing themselves. M j Costello stated the purpose of the conference. Ms. Johansen reviewed the ;

specific issues raised during the inspection, particularly the failure to file for l reciprocity for a number of years after filing in 1993 and if any work was 1 performed in NRC jurisdiction during 1994 and 199 Mr. White revievcer, The apparent violations concerning: 1) the failure to file for reciprocity prica ::;wforruing licensed activities in NRC jurisdiction: 2) use of a radioactive materia!s package in an impaired condition and 3) failure to mark a transpo.7 packagr, with the letters "RQ". Mr. White asked the licensee's representative; to describe how field work was assigned in 1993 compared to c:urrent procedure Mr. Herbert stated that in 1993, he owned the company along with Mr. Alex Moyseenko. During that period, Mr. Moyseenko was responsible for assigning work while Mr. Herbert spent most of his time in the field. Mr. Moyseenko was fired by Mr. Herbert in the fall of 1994 and the office manager (Mr. Herbert's daughter) became responsible for assigning field work until late 1995 when M Murray was hired. Mr. Herbert was not sure how Mr. Moyseenko became aware of NRC's reciprocity requirements in 1993, but he speculated that the general contractor for the Somerset Hospital job may have told Mr. Moyseenko of the requirement.

Mr. Costello asked Mr. Herbert if he knew that filing for reciprocity required the  ;

payment of a fee. Mr. Herbert stated that he recalled that his company filed for reciprocity in 1993 and that there was a fee associated with it. He further stated j that he did not pay the bill himself. Mr. Herbert also stated that although he was  !

i aware of NRC's reciprocity requirements in 1993, he had forgotten to file the i other times his company worked in NRC jurisdictio l i

Mr. Murray' stated that the licensee's correc'tive actions concerning reciprocity  !

Included immediately stopping work at the Mountainview Reclarnation Center in l Greencastle, Pennsylvania, filing a Form 241 and obtaining written approval prior j l - to re-starting work. Mr. Murray further stated that the company was applying for i

.an NRC license since their contract at the Mountainview facility requires the . i

' licensee to be present for more than 180 days this year.' Mr. Herbert stated that . l Mr. Murray will serve as Radiation Safety Officer (RSO) on the NRC license. The licensee requested that Mr. Murray be designated as RSO in ! ate 1996 when the i licensee filed for renewal of their Maryland license. The Maryland license is i currently in timely renewa l Ms. Johansen asked the licensee's representatives if the State of Maryland i notified them of the requirement to file for reciprocity when working in NRC- }

jurisdiction. Mr. Herbert stated that they did no !

locatiens in Pennsylvania and West Virginia. One particular location mentioned was Franklin Storage in Pennsylvania and a number of federal facilities in _

l Maryland. Mr. Herbert and Mr. Murray both stated that they were not aware of the requirement to file for reciprocity while working at a federal facility in an Agreement State until the April 1997 inspectio Mr. White asked the licensee representatives what actions'were taken regarding  ;

the' damaged transport containers. Mr. Murray stated that all transport containers l~ for the gauges have been replaced and the letters "RQ" have been marked on all container j Ms. Walker discussed the NRC's enforcement option Mr.' Costello thanked the licensee for participating in the conference and closed the meetin !
