Attachment A is a table providing a comparison between statements in the notes, the inspection report, Maine Yankee's response, and the NRC safety evaluations of the fire protection program. The left hand column of the table contains statements from the Atherton '

notes. The remaining columns contain statements from the other references and/or Maine Yankee's resolution of the issue from the notes statement. Blank spaces in the table indicate that there are no corresponding statements in the other references. Shaded spaces indicate .

that the notes statement contains descriptive wording only and requires no response. Response: The right hand column of Attachment A lists those documents which I describe modifications completed by Maine Yankee to comply with requirements of the SER's. If there was an exception to the SER's then the alternative installation is listed along with the document accepting it.

3. Where the notes assert that "the staff requires" certain modifications or licensee
actions, comment on Maine Yankee's understanding of whether the staff in fact required such modifications of actions. If Maine Yankee believes the staff did require them, identify Maine Yankee's implementation.

Response: The columns in Attachment A beneath the USNRC Safety Evaluations list the staff's requirements as understood by Maine Yankee.

Maine Yankee has determined that the cable separation inadequacies discussed by Mr.

l Atherton and repeated in the NRC letter to Maine Yankee dated September 21,1977, are

! different from and not related to the separation issues currently being addressed by Maine Yankee Design and Engineering Staffs.

The current issue is related to electrical design criteria which are implemented to insure that insulation breakdowns, physicalimpacts, and maintenance activities cannot disable redundant trains of safety related equipment. These criteria require that cables he separated from each other in redundant metal conduit, ducts, cable trays or other physical barriers. In some cases the criteria are met by a separation of a few inches, e.g., the wires inside control and instrument panels. Maine Yankee has discovered that some electrical design changes

< implemented after original construction, primarily in the 1980's, did not adhere to these criteria in every case.

In contrast, based on our analysis of the Atherton notes, we believe Mr. Atherton's concerns focus on fire protection and assume that t design basis fire would consume everything in a given building or portion of a building.The construction electrical separation criteria were never intended to insure that redundant cable or equipment could survive a catastrophic building fire as Atherton correctly ludicated in his notes.

The NRC apparently agreed with Mr. Atherton, and recognized that the purpose and intent of the construction separation criteria (i.e., to provide adequate electrical separation) was different from the new fire protection criteria developed five years after construction was completed at Maine Yankee.The September 21,1977 NRC inspection report states in part:

"The current NRC staff guidance provided in Regulatory Guide 1.75 was not available at the time Maine Yankee was designed and constructed. Cables for redundant safety related divisions were routed as follows to provide what was believed at the time to be adequate separation:

(1) In separate exposed rigid metal conduit (2) In separate concrete encased plastic or metal ducts in the same duct bank (3) In separate cable trays with horizontal separation. Tray sides were considered adequate barriers.

(4) In separate cable trays separated vertically by solid tray covers (5) In separate barrier sections of the same tray.

While the existing separation provisions do provide electrical separation, at many locations they provide little or no protection against fires."

Mr. Atherton concluded that no installation of fire protection provisions alone would correct all of the deficiencies, and a safe shutdown system completely independent of all plant areas outside containment should be provided.The NRC apparently agreed through rulemaking on

" Appendix R", which required alllicensees to meet new fire protection criteria including an independent safe shutdown system similar to Mr. Atherton's concept.

Maine Yankee installed an Alternate Safe Shutdown System in 1984. This system resolved open issues from Reference (f) and meets the strict requirements of Appendix R. It includes a third path of safe shutdown equipment, a third diesel generator and power distribution center, and lube oilleakage collection systems. The system also constitutes resolution of Mr.

Atherton's primary concerns regarding cable separation for fire protection in that it recognizes that for Maine Yankee design, cable separation alone is not sufficient to protect against fire.

'l To summarize, the current Maine Yankee cable separation issues are distinct from the Atherton issues for two reasons:

1. The Atherton issues were concerned with fire protection; the current cable separation issues have to do with electrical separation concerns unrelated to i fire protection, and
2. The vast majority of the current cable separation concerns were introduced through design changes. Most of the design changes occurred after the

! Atherton inspection at Maine Yankee.

5. The notes identify concerns regarding fire barrier penetration seals. In addressing these concerns, comment on their relationship to recent fire barrier penetration seal issues.

Response

At the time of the inspection conducted by Mr. Ath.erton, August 1 through August 5,1977, there were few fire penetration seals installed at Maine Yankee or any other nuclear plant, as j

, indicated by Mr. Atherton's notes. As a result of requirements stemming from the NRC i evaluation of the fire at the Brown's Ferry Plant in 1975, Maine Yankee installed seals in those areas identified by Mr. Atherton and additional seals in areas not mentioned by Mr. Atherton but identified by Maine Yankee or other inspectors. The seals were installed using the

, materials and installation techniques in common practice at the time. This program resulted in excess of two thousand sealinstalletions.

A review of recent industry e:iperience regarding the adequacy, design, and continued

reliability of fire seals instalkd two decades ago prompted Maine Yankee to begin a systematic inspection, and if required, replacement program for currently installed seals. This program
was initiated after the end of the 1995 outage. The program is a Maine Yankee initiative and

predates any knowledge of Mr. Atherton's recently disclosed notes.Through this initiative a number of discrepancies of the sealinstallations were identified as indicated in LER 96-017 dated July 29,1996; and deficient seals are being replaced. It is Maine Yankee's goal to insure

, the seals in the plant meet the design and installation standards developed as the result of fire protecilop industry experience in the twenty years since Mr. Atherton's visit.

I Consequently, Maine Yankee sees no relationship between Mr. Atherton's comments in 1977 with the inspections and upgrades to Fire penetrations scab currently underway.
