SUBJECT:

DRAFT PROPOSAL FROM ILLIN0IS FOR AGREEMENT STATE STATUS We have reviewed the State of Illinois draft proposal for Agreement State

! status as requested in your August 12, 1985, memorandum. The following are our comments on those documents:

1. On pages 310-10, 310-11, and 310-17 of Volume III, Regulations, the j concept of " transport groups" is discussed. This concept is no longer used by the NRC and has been replaced by the "Al" and "A2" maximum activity values described on page 341-1 of Volume III.
2. We believe that the wording in Section 310.7,a), on page 310-14a which '

authorizes IDNS to inspect any radiation installation, whether or not it is licensed by IDNS conflicts with the Agreement State program policy of excluding certain licensees (i.e. Federal Agencies, nuclear power plants, large quantities of Special Nuclear Material) from state jurisdiction. l

( 3. On page 330-34, item e., it states that the state may receive an application for a license for source material milling. This has been /

excluded from the Illinois proposal. Likewise, on page 331-7, item C lists fees for refining uranium mill concentrates, which is not authorized under the agreement.

4. The address for obtaining copies of Reg Guides on pages 340-6 and 340-8 /

should be:

5. Additional narrative should be added to describe how the state will /

handle unique and complex licenses such as Alliad Chemical.
