Dear Ms. Garde:

This is in further response to your letter dated January 21, 1985, in which you requested, pursuant to the Freedom of Infomation Act (F0IA), records relat'ed to the NRC Comanche Peak Task Force established in March,1984.

The NRC staff has completed its review of those records subject to your request that were identified by asterisks on Appendix A (Test Procedures and Coatings categories) transmitted to you by our letters dated October 4,1985, and October 16, 1985.. The disposition of those records identified on Appendix A, a copy of which is enclosed, is described below.

The records numbered 15, 54 (allegations 17 and 44), 74, 75, 76, 81, 82, and 86 contain deletions without invocation of a F0IA exemption in accordance with the agreement between you and the NRC staff at a meeting on May 8,1985, concerning your pending F0IA requests pertaining to the Comanche Peak Technical Review Team activities. This agreement was summarized in a letter to you from Joseph M. Felton, dated May 15, 1985. The information that has been deleted consists of names and other identifying information concerning allegers, interviewees, and other individuals whose privacy could be invaded by disclosure of this information.

The records numbered 11 and 77 are being withheld from public disclosure pursuant to Exemption (4) of the F0IA (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Commission's regulations because they contain commercial information provided in confidence to the NRC. These records are test packages which contain:

(1) names and identities of individuals which are excluded from your request by the above-mentioned agreement with the NRC staff and (2) test questions and answers and scores for quality assurance instructor qualifications which are proprietary to Texas Utilities Generating Company.

These records are being withheld in their entirety because their release would result in competitive harm to the company providing this information.

The nonexempt portions of the documents referenced above are being placed in the NRC Public Document Room in file F01A-85-59 under your name. A separate l

set of the records is being made available for public inspection and copying at the Local Public Document Room located at the University of Texas Library, 701 South Cooper Street, Arlington, Texas.

Clinic is currently assisting several citizens groups, local governments and intervenors in the central Texas area concerning the construction of the Comanche Peak nuclear power plant.
