PARTIAL VOTE ON SECY-96-199 - PLAN TO BETTER FOCUS RESOURCES ON HIGH PRIORITY 01 DISCRIMINATION CASES In SECY-96-199. dated September 13. 1996, the staff discussed harassment.

intimidation and discrimination cases and offered a " PLAN TO BETTER FOCUS RESOURCES ON HIGH PRIORITY 01 DISCRIMINATION CASES" in response to an earlier ComM ssic.1 direceive.

Subsequent to this submission. the Commission provided additional questions on the subject for the staff's consideration.

In its December 16. 1996 response to those additional questions, the staff noted, as a separate matter, that --

l SECY-96-199 also addresses issues associated with predecisional enforcement conferences. The staff recognizes that the Commission may need some time to resolve the issues presented in SECY-96-199.

Therefore the staff would appreciate [it] if the issues associated with Jredecisional enforcement conferences discussed at pages 17-19 of SECY-96-199 [were to] be addressed in advance of the remaining issur.

This will allow the reprint of the 4

Enforcement Policy to reflect changes associated with conferences I

in SECY-96-199 if approved by the Commission.

For my part. I am prepared to vote now on the predecisional enforcement i

conference aspects of SECY-96-199 since these )roposals do not appear to effect major provisions of the Plan submitted )y the staff or the resources that might be required to implement the Plan.

As to predecisional enforcement conferences in harassment, intimidation and discrimination cases. I approve the staff's proposals on such conferences 2

that are set forth at pages 17-19 of SECY-96-199 and I approve the staff's proposal to reflect those matters, as it deems appropriate, in the next reprint of the Enforcement Policy.

This partial vote may be publicly released.

This partial vote is limited to the predecisional enforcement 2

conference pro)osals at the noted pages of SECY-96-199. and does not address any otler issues that are raised in SECY-96-199 or in the staff's December 16. 1996 supplemental response.

STAFF REQUIREMENTS - SECY-96-199 - PLAN TO BETTER FOCUS RESOURCES ON HIGH PRIORITY OI DISCRIMINATION CASES The Commission has approved the portions of this paper that address the changes to predecisional enforcement conferences in harassment, : intimidation and discrimination cases as set forth on pages 17-19.

The staff should incorporate those changes in a revision to the Enforcement Policy.

Based on the increased FTE requirements discussed in the(EDO) dated memorandum from the Executive Director for Operations December 16, 1996, the staff should re-evaluate the material in this paper.

In particular, recent experience with the application of the revised Management Directive 8.8 criteria for designation of high priority investigations should also be reconsidered since under its application, 93% of the discrimination cases are now high priority.

Whether or not the the staff proposes adjustments to the prioritization scheme, staff should consider resources necessary to investigate these impact they high priority discrimination cases and indicate what would have on other important investigations or activities.
