1 I concur with Commissioner McGaffigan's comments in his memorandum of December

20. 1996, on SECY-96-199. Thus. I approve the staff's proposals on sages 1719 of SECY-96-199 relating to predecisional enforcement conferences in 1arassment, intimidation and discrimination cases. This partial vote does not address other issues that are raised in SECY-96-199 or in the staff's December 16, 1996, supplemental response.

I also concur with Commissioner Dicus' recommendation. with her partial vote on January 7.1997, that the ED0 should re-evaluate the remaining proposals in SECY 96-199 before the Commission votes on the remaining issues. A reassessment of these proposals is warranted in light of the additional information and increased FTE implications that are discussed in the staff's December 16. 1996, supplemental response.

The ED0's evaluation should include consideration of whether revisions should be made to the proposals in SECY 96-199, Also other aspects of the handling of discrimination cases should be considered in light of the staff's recent experience with application of the revised Management Directive 8.8 criteria for designation of high priority investigations.
