NRC SPECIAL INSPECTION REPORT NO. 50-302/97-06

Dear Mr. Anderson:

This refers to the inspection conducted on March 19 through March 21,1997, at the Crystal

i

l

River facility. The purpose of the inspection was to follow up on the addition of required

l

operator actions for small break loss of coolant accident mitigation. The enclosed report

presents the results of this inspection.

l

Based on the results of this inspection, an apparent violation was identified and is being

considered for escalated enforcement action in accordance with the " General Statement of

Policy and Procedures for NRC Enforcement Actions"(Enforcement Policy), NUREG-1600.

,

The apparent violation involves three examples of inadequate safety evaluations for operator

actions added for design basis small break loss of coolant accident mitigation. This apparent

'

violation is of concern because your emergency core cooling system is not able to respond

l

automatically to a design t' asis event, but instead it now relies on the accomplishment of

seven different operator acuans within the first 20 minutes of an event. Your addition of

!

l

operator actions to the system design basis could result in both the possibility of a

l

malfunction of a different type (i.e., operator error) and an increase in the probability of

l

occurrence of a malfunction of equipment important to safety. These changes involved an

unreviewed safety question and were implemented without the required prior NRC review and

approval.

Accordingly, no Notice of Violation is presently being issued for these inspection findings. In

addition, please be advised that the characterization of the apparent violation described in the

enclosed inspection report may change as a result of further NRC review.

You will be advised by separate correspondence of the results of our deliberations on this

matter. No response regarding the apparent violation is required at this time.
