Enclosed for your information is the synopsis of the Nuclear Regulatory Commission (NRC) Office of Investigations completed report regarding alleged l

discrimination by Florida Power Corporation against an employee for reporting safety concerns. That employee did not file a complaint with the U.S.

Department of Labor.

i SYNOPSIS On August 8,1995, alleger was interviewed as a witness to two evolutions which were conducted by a reactor operating crew, of which he was a member, at the Crystal River Nuclear Plant to test the validity of an operational curve for make up tank pressure and volume. Based on the fact the operato;5 informed management of only one of the evolutions, management took disciplinary action against four of the crew members, prompting three of them to file a complaint of discrimination for reporting safety concerns with the U.S. Department of Labor (DOL). The alleger did not file a complaint with the DOL like the other three, but when interviewed by the Office of Investigations, the alleger claimed he was discriminated against by Florida Power Corporation management for raising safety issues with regard to the accuracy of the curve. The complaint was dismissed as invalid by an

' administrative' law judge for the other three crew members.

Based on the evidence developed during several OI investigations in conjunction with DOL findings, there was not sufficient evidence developed to substantiate the allegation of discrimination.
