Dear Mr. Aftergood:

This is in final response to your letter dated May 16, 1985, in which you requested, pursuant to the Freedom of Information Act (FOIA), copies of three categories of documents related to the proposed rule for limiting the use of highly enriched uranium in research and test reactors.

The nine documents identified on the enclosed Appendix D are being placed in the NRC Public Document Room (PDR) located at 1717 H Street, NW, Washington, DC 20555, in file folder F01A-85-379 in your name and are enclosed. The 15 documents identified on enclosed Appendix E are already available for public inspection and copying in the PDR. I have indicated the file location beside each document description.

Trubatch to Commissioner Bernthal dated September 24, 1984, was denied in our October 29, 1984, response to a previous F0IA request from Daniel Hirsch (F01A-84-784). , y g This is a- request under the Freedom of Information Act, as amended.

I would like to obtain the following categories of documents related to the Comission's proposed rule curbing the use of high enriched uranium (HEU) in domestic research reactors (49 Federal Register 27769) .

(i) All documents prepared by the Staff containing evaluations of the proposed rule or of the coments submi tted on i t; containing proposed modifications of the rule; containing recommendations for Comission action on the proposed rule.

(ii) All documents provided to the Department of State, to Euratom, or to other agencies, domestic or foreign, concerning the proposed rule; as well as all materials provided in response.

(iii) All other correspondence, to or f rom the Comission, regarding the proposed rule which has not previously been placed in the Public Document Room.

The Committee to Bridge the Gap is a non-profit public interest research organization which has been actively involved in the development of the proposed rule to curb the use of HEU. The materials requested will be used to support research in progress on the desi rabili ty of eliminating to the maximum extent possible the use i of HEU. Results of our work will be made available wi thout charge t to the Commission, the Congress, and the public. We therefore request a waiver on production costs.
