Gentlemen:

Subject: Meeting Report Nos. 50-277/85-42; 50-278/85-42

An Enforcement Conference was held on November 14, 1985, at the NRC Region I

office, King of Prussia, Pennsylvania, to discuss several recent transportation

events concerning Peach Bottom Atomic Power Station and your actions as a

result of your investigations of the causes for the events. All except the

latest event have been the subject of previous NRC or State actions. The

latest event was identified in Special Inspection Report No. 50-277/85-39;

50-278/85-40, and is the subject of the Notice of Violation described in

Appendix A.

The topics discussed at the enforcement conference are described

in the attached Meeting Summary.

Based on our review of the results of the inspection at Barnwell, South

Carolina, conducted by a representative of the South Carolina Department of

Health and Environmental Control on October 18, 1985, of a shipment from Peach

Bottom Atomic Power Station, it appears that one of your activities was not

conducted in full compliance with NRC requirements, as set forth in the Notice

of Violation, attached as Appendix A.

The violation involved lifting cables

that were not accessible at the burial site.

The violation has been cate-

gorized at the Severity III Level in accordance with the " General Statement of

Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C

(1985).

The violation for which you have been cited has already been the subject of

enforcement action by the State of South Carolina on October 21, 1985. On

October 21, 1985, the State of South Carolina assessed a civil penalty of

$1,000.00.

In addition, your South Carolina Waste Transport Permit was sus-

pended until you demonstrated compliance with State and Federal Laws. We

have exercised our discretion under our Enforcement Policy and decided not to

issue a civil penalty in this case. Our decision is based on (1) the actions of

the State of South Carolina, (2) the timely corrective actions you have taken

for this and previous transportation violations discussed during the Enforcement

Conference, and (3) your thorough presentation of issues and corrective actions

at the Enforcement Conference.

You are required to respond to this letter and in preparing your response, you

should follow the instructions specified in the enclosed Notice.
