1. INTRODUCTION This procedure describes the objectives and procedures for preparation, submittal, review and comment on proposed and final regulations.
11. OBJECTIVES The objectives of this procedure are:

A. Provide guidance for use by States on preparation and submittal of proposed and final State regulations for NRC staff review.

B. Establish the procedures to be followed by NRC staff for review of State regulations including the scope of review, staff responsibilities, and products l to be prepared and communicated to the State documenting the results of ,

the review.

C. Provide guidance to NRC staff on whether differences identified in State i regulations are significant.

111. BACKGROUND )

A. Each Agreement State has the responsibility to promulgate regulations that l satisfy the compatibility requirement of Section 274 of the Atomic Energy Act of 1954, as amended. Because each Agreement State possesses detailed knowledge of its own regulations, Agreement States are best able to determine that their regulations are compatible with NRC regulations and where not compatible, for stating why they are not compatible.

B. Agreement States routinely submit proposed amendments to their regulations, usually when they are published for public comment, for review and comment by NRC staff. Agreement States also routinely submit final regulations for review and an NRC determination whether each regulation satisfies the compatibility designation associated with equivalent regulations i of the Commission. The Office of State Programs (OSP) Internal Procedure l D.7, Procedure for Reviewing State Regulations, is used for review.

C. To help States promulgate compatible regulations within three years of the effective date of changes in NRC regulations, NRC staff prepares and periodically publishes a Chronology of Amendments. IV. GUIDANCE FOR USE BY STATES ,

A. Agreement States should submit proposed and final regulations to the ,

Deputy Director, OSP, for NRC staff review.

B. Non-Agreement States seeking Agreements should submit proposed and final regulations to the attention of the Deputy Director, OSP, for NRC staff review.

C. Appendix A to this procedure provides guidance for use by States on the ,

form, content and process to be followed for preparation and submittal of proposed and final regulations to NRC staff for review.

D. The State, in its transmittal letter is requested to identify the date comments are needed from NRC.

V. GUIDANCE TO NRC STAFF A. Staff Responsibilities i

1. The Director, OSP, has overall responsibility for the review and determination of the compatibility of Agreement State regulations.

The Deputy Director, OSP, has primary responsibility for coordinating the review of Agreement State regulations. The State Regulations Review Coordinator (Coordinator) is responsible for overall quality  !

control of the review process and for keeping the OSP Management ,

Analyst informed when an Agreement State regulation is received so r the status of the review can be tracked by the OSP Management ,

2. The Deputy Director, OSP, is designated to receive existing l Agreement State regulations and to assign Agreement State j regulation reviews to the Regional State Agreements Officer (RSAO) or OSP staff, and to inform the Coordinator. First, the RSAO will be requested to conduct the review. If the RSAO is unable to complete the review in time to return comments to the State by the requested date, the Deputy Director, OSP, within three days will assign OSP l staff to assume responsibility for the review, or to the OSP j regulations review consultant. The reviewer will normally notify the State and agree on a date for completion. If the OSP regulations review consultant will conduct the review, the Coordinator will notify the State and arrange a mutually agreeable completion date.

3. The OSP staff reviews all non-Agreement State regulation'; submitted by States seeking to enter an Agreement with NRC using the same guidance as for Agreement States.
4. All Agreement State regulations should be reviewed following guidance in Section B.
5. Review of complex regulations may require the expertise of other NRC offices. The reviewer should consult with the Office of Nuclear Material Safety and Safeguards (NMSS), the Office of Nuclear Regulatory Research (RES), the Office of the General Counsel (OGC) or other NRC offices as necessary to support completion of the review based on the issues raised during the review and their significance. Alternatively, the reviewer may formally submit the regulations, or germane parts, for review to one or more of the above offices, as necessary. If requested, NMSS, RES and OGC, or other NRC offices, review State regulations according to their own internal procedures. The Deputy Director should, if necessary, conduct rneetings with commenting offices to resolve differing views. For the caso of non-Agreement State submittal, the entire regulation package will be submitted to the NRC offices mentioned above for review.
6. The reviewer is responsible for preparing the comment letter back to the Agreement State and obtaining the concurrence from NMSS, RES, or other NRC offices when required. For reviews conducted by the RSAO, the concurrence of the Regional Counsel may be required fo!!owing Regional practice. The concurrence of OGC is always required. The Deputy Director, OSP, signs the comment letter prepared by the reviewer.

B. Review Guidance for Proposed and Final Regulations

1. Public Responsiveness Requirement Staff should notify the State by phone or E-mail within two weeks of receipt of an Agreement State regulation package that it has been received. The notification should include whether the staff expects to be able to meet the State's requested date for comments. If not, the staff should establish a revised date that is acceptable to the State.
2. General Review Guidance The following references are useful in the review of Agreement State regulations.

b. The latest Chronology of Amendments provided to the States by All Agreement States letter.
c. The current OSP Internal Procedure B.7 - Criteria for Compatibility Determination:
d. Current compatibility divisions shown in the Agreement State Regulations Review Record (Appendix B).
e. Criteria for Comparing Regulations and identifying incompatibilities (Appendix C).
3. Specific Review Guidance
a. The staff reviews Divisions 1 and 2 regulations based on current compatibility divisions in B.7 and those in the Agreement State Regulations Review Record. The reviewer examines the regulations package to verify which NRC

, regulations the State considered based on the amendments listed in the Chronology of Amendments. The results of the _

review are recorded in the Agreement State Regulations Review Record using Criteria for Comparing Regulations and i identifying incompatibilities.. NRC staff does not usually perform a review of Division 3 regulations. Appendix A, Guidance to Agreement States for Submitting Regulations for NRC Staff Review gives more details. The NRC staff makes a regulation compatibility determination at the time of review of final regulations. A formal comment letter is sent to the State documenting the review results (Appendix D for proposed regulations and Appendix E for final regulations).

b. The reviewer should compare the regulation submitted by the State to the equivalent NRC regulation and especially the line-in/line-out portions. The comparison should be documented using the Agreement State Regulations Review Record. For subsets of regulations, only prepare those portions as appropriate. The reviewer examines the wording of the State regulations to determine if the State properly evaluated the required compatibility. Describe acceptable (i.e., non significant) variations between equivalent State and NRC regulations. The reviewer notes all differences between State and NRC regulations that change or affect the basic intent of the regulation or are different using guidance in B.7. Based on the results of the comparison, the reviewer should conclude whether or not the State regulation is compatible with the equivalent NRC regulation. The reviewer drafts comments for the case of a determination that a State regulation is not compatible. c. When the NRC staff has reviewed a previous version of the regulation, retrieve and review any comments returned to the State on the subject regulations to examine how the State addressed the comment.
d. The reviewer provides for concurrence the completed State regulations review package (including the Agreement State Regulations Review Record with comments and reviewers notes and the comment letter) to OGC, and other offices involved in the completion of the review.
4. Contractor Assistance A request for consultant or contractor assistance in review of proposed or final State regulations can only be initiated by the OSP technical monitor, but requires the concurrence of the Director, OSP.

When using such assistance, the Coordinator should:

a. Prepare a cover letter and attach the regulations package for forwarding to the consultant or contractor following the instructions of the technical monitor, including the instruction to follow this procedure to conduct tne mview,
b. Evaluate the comments as the basis for development of a comment letter to the State upon return of the consultant's or contractor's review report. Evaluate and make a compatibility determination for each difference noted in the report.

S. Communication of the Review Results

a. The staff reviewer should assemble the comments on the State regulations using the Agreement State Regulations Review Record. The Record will serve as background information to the comment letter and will not be submitted to the State.
b. The reviewer should prepare a formal comment letter or "no comment" letter to the State documenting the review results on each package of State regulations. Address the letter to the State Radiation Control Program Director unless State staff specifies otherwise. The Deputy Director will normally sign the letter for regulation reviews. All offices participating in the review and OGC should be on concurrence,
c. The letter should contain the following: l general observations on the State's regulations if appropriate; D.7.14 Revision 3,4/ /97 ,

D,7 - Procedure for Reviewing State Regulations Draft 4/17/97 statement that the regulation is or is not compatible; a separate enclosure for the comments on the sections that are not compatible; and the date on which the NRC staff notified the State of receipt of the regulations package and any informal communications with the State.

Samples for a proposed rule is shown in Appendix D and for a final rule is shown in Appendix E.

d. Allletters should use the Regulatory Information Distribution System (RIDS) codes SP05-08, corresponding to NRC Regions I-IV, on the concurrence sheet,
e. After determining the compatibility of final regulations, the reviewer should provide the information to the Coordinator for quality control and the OSP Management Analyst so that the compatibility determination can be entered and to update the status or close out the action in the tracking system.
f. The final comment letter back to the State closes out the action. If the State submits a revised regulation in response to an NRC comment letter, it will be tracked as a separate item by OSP.

Appendix A GUIDANCE FOR USE BY AGREEMENT STATES FOR SUBMITTING REGULATIONS FOR NRC STAFF REVIEW

l. Introduction This guidance to Agreement States and States seeking an Agreement pertains to the submittal of proposed and final Agreement State regulations to NRC staff for review to confirm that they are compatible with equivalent regulations of the NRC.

NRC's goal is to is to conduct a single review for proposed regulations (either at the draf t stage or the public comment stage) and a single review for final promulgated regulations. Although many States base their regulations on Suggested Stato Regu!ations (SSRs), until the SSRs are updated and reviewed with regard to compatibility, the State should not assume that State regulations based on SSRs are necessarily compatible. The NRC review process comparos all State regulations with the equivalent regulations of the NRC.

II. State Submittal Guidance A. For proposed regulations at the draft stage or public comment stage, the Radiation Control Program Director (Director), in preparing and submitting proposed regulations, is requested to identify by line-in/line-out text, or similar identification, the changes to NRC's regulations that are being  !

incorporated into the State's regulations. The Director should identify at I what point in the State's regulatory process NRC's review would be of most benefit to the State, either at the draft stage or the public comment stage.

For final promulgated regulation changes, the Director is requested to identify by line-in/line-out text, or similar identification, the changes made between the proposed regulation submitted above and the final regulation and how the State incorporated NRC's comments on the proposed regulation. Also, the Director is requested to submit an electronic version of the regulation, whenever possible, using a word processing software that is compatible with

" Wordperfect 5.1" or higher.

B. The Director should submit proposed regulations to the Deputy Director, OSP. The regulations should be submitted at least sixty days before the State needs the comments, or concurrently with the State publication of the proposed regulation.s for public commen', whichever is earlier Final regulations as officially adopted by the State should be submitted to the Deputy Director, OSP, for review after the regulations are published. The State should identify the date by which they need comments from NRC in its transmittal letter.

C. With the proposed or final regulation, the Director is requested to document whether the Agreement State believes its regulation satisfies the compatibility criteria, if the regulation does ng_t satisfy the compatibility designation, the Director should identify sections of the regulation that do D.7.17 Revision 3,4/ /97

CRITERIA FOR COMPARING REGULATIONS AND IDENTIFYING DIFFERENCES THAT DO NOT AFFECT COMPATIBILITY

1. DIFFERENCES THAT DO NOT AFFECT COMPATIBILITY in most cases, the following differences in the wording between State and NRC regulations do NOT affect compatibility. These differences do not need to be identified or commented on in the review record.

A. Differences that result from the State regulation being made applicable to sources of radiation not covered by the Atomic Energy Act (e.g., x-rays, naturally-occurring and accelerator-produced radioactive materials);

B. Differences between the ordering of the subdivisions of the NRC and the State regulations; C. The substitution of terms with the same meaning (where the use of identical terms is not required) according to the editorial style of the State, i.e., "shall" or "must," " rule" or " regulation," " Commission" or " agency," " device" or " equipment";

D. The omission of any portion of the text of an NRC regulation that provides an example, contains supplementary material, or provides a reference to another regulation for the convenience of the reader; E. The incorporation, as a requirement in the State regulation, of any portion of the text of an NRC regulation that provides an example, contains supplementary material, or provides a reference to another regulation for the convenience of the reader, F. Review ofIState Remulation Citation 1 Anainst Compatibility Division I and 2 Criteria State NRC  ; D.iL En!s Subiect and Comments 1 D.703 20.170 Use of1ndividualRespiratory Protection Equipment. , Section D.703 a.vi. uses the words "the licensee shall use equipment within the equipment manufacturer's expressed limitations for type and mode..." Reference only to the manufacturer's limitations may narrow the scope of the rule. This narrowing may inadvertently result in a licensee failing to comply with limitations established by NIOSH or MSHA, especially if those , limitations are not included (for any reason) in the manufacturer's literature. This rule is a Division 1 matter of compatibility. We suggest that [ State] use , the more general wording set out in Section 20.1703(a)(6), which would j encompass both the manufacturer's and any NIOSH or MSHA limitations. , I i 2 D.801 20.1801 Security of Stored Material. i Section D.801 does not include the entire phrase "...shall secure from , unauthorized removal or access..." as set out in Section 20.1801. The words "or access" have been deleted. This section, as written, may not require an equivalent level of security. For example, the rule may not cover a situstion j where an unauthorized individual gained access to a storage location and l removed radioactive material from it's shielding / packaging, but did not ' physically remove the material from the storage location. Staff was unable to find an equivalent section in the State regulations.
