Duke Power Company is an active member of the Westinghouse Owners Group (WOG) and is participating in the WOG AMSAC Generic Design Program.- The results of this program were provided in WCAP-10858 AMSAC Generic Design Package which was submitted to NRC by letter dated July 25, 1985 (0G-156). We understand that Staff review of this document is still in progress.

The ATWS rule requires that licensees provide a proposed implementation schedule 180 days af ter the quality assurance guidance was provided. This guidance was provided by GL 85-06 dated April 16, 1985. Accordingly, the following schedule'is proposed.

Duke needs to evaluate the impact of the NRC Staff SER on each.of the designs described in WCAP-10858 in order to determine which logic is best suited for McGuire and Catawba and to determine the schedule when the required hardware changes may be installed. The implementation schedule will not occur during the 1986 refueling outages (second refueling outage af ter July 26, 1984) as requested by the rule. Rather, the date will be some time in the future depending on when NRC approves the design.

This schedule is justified for the following reasons. There was an unexpected delay in the issuance of the generic QA guidance for ATWS equipment. This caused a delay in the submittal of the Westinghouse.0wners Group AMSAC Generic Design Package. The NRC Staff is still reviewing this package and is not expected to be complete until November, at the earliest. This approvc1 date would not allow sufficient time to prepare plant modifications for implemen-tation during the 1986 refueling outages.

In fact, depending on Staff requirements associated with approval,' sufficient time may not be available to design the modification and,,repare for implementaiton in time for.the 1987 refueling outages. Due to these uncertainties, it is not practical to offer a firm implementation schedule at this time.
