Inspection No. 50-293/86-04
An inspection was conducted by a representative of the South Carolina Depart-
ment of Health and Environmental Control on January 2,1986 of a shipment of
radioactive waste from the Pilgrim facility. The shipment was inspected upon
its arrival at the Chem-Nuclear Systems, Inc., burial site at Barnwell, South
Carolina.
Areas examined during this inspection are described in a report by a represen-
tative of the South Carolina Department of Health and Environmental Control
which is attached to the NRC Inspection Report enclosed with this letter.
The
inspection consisted of a review of shipping papers, placarding, marking and
labeling, radiation measurements, selective contamination surveys and examin-
ation of the packages and the tractor-trailer.
Based on the results of the inspection, it appears that one of your activities
was not conducted in full compliance with NRC requirements as set forth in the
Notice of Violation enclosed herewith as Appendix A.
The violation in Appendix
A has been categorized at the severity level described in accordance with the
NRC Enforcement Policy (10 CFR 2, Appendix C). Details are provided in Appen-
dix A.
You are required to respond to these findings by following the instruc-
tions included in Appendix A.
The violation for which you have been cited has already been the subjrtt of
enforcement action by the State of South Carolina. On January 7, 1986, the
State of South Carolina assessed a civil penalty of One Thousand Dollars
against you. You were also required to submit evidence that adequate measures
had been implemented to assure compliance with the state and federal law.
In view of the circumstances surrounding this matter, we have exercised our
discretion under the Enforcement Policy and have chosen to issue the enclosed
Notice of Violation at this time.
