Sealed sources need not be. leak tested if they are not designed to emit alpha l

g particles, are in storage, and are not being used. However, when they are y

removed from storage for use or transferred to another. person, and have not 5

been tested within the required leak test interval,=they shall be tested before E

use or transfer. No sealed source or detector cell shall be stored for a E

5 period of more than 10 years without being tested for leakage and/or E

l contamination.

The leak test shall be capable of detecting the presence of 0.005 microcurie of E

If the test reveals the presence of E

with the U.S. Nuclear Regulatory Commission in accordance with 10 CFR E

5 decontaminated, repaired, or disposed of in accordance with Commission E

The report shall be filed within 5 days of the date the leak test E

I am writing to request two modifications to Matenals License # SNM 1171, currently held by Jackson Community College. The first modification concerns the addition of myself. Prof. Chris J.

DeMarco, curreatly radiation safety officer, to the license as an authorized user. The second modification concerns the addition to the license of a Co-60 source, which is currently being stored, but is not in use, at our facility. Details concerning these two modific'ations can be found

In three letters, dated February 27, August 1, and August 14 (all 1995), Prof. Lawrence A.

Hitchingham (currently listed as the sole authorized user) attempted to modify our license in such a rnanner as to have me included as an authorized user, due to his then-impending retirement.

Unfortunately, these appears to have been a misunderstanding; while I was added to the hcense as 1

radiation safety officer, I was not included as an authorized user.

Prof. Hitchingham's retirement was effective at the end of August 1996, and 1 am scheduled to perform a lab in which the PuDe source will be used daring the first week offebruary 1997. Prof.

Rhchingharn stilllives in the area, and he has agreed to come in and operate the source fbr that lab, but the situation is clearly inconvenient for the both ofus. I hereby request that i be added to the license as an authnrized user as noon as possible. A brief overview of my backgiound was in-ciuded in Prof Hitchingham's letter of Febmary 27,1995, and is reproduced on the next page.

Both Prof. Hitchingham and myself apologize for our part in helping to create this misunder-standing, and we hnpe that the situation can be rectified as quickly as possible.

I was licensed in the use of X-Ray equipment while working as a sesearch aalstant at Arieona State University, I worked closely with Proc Hitchin;; ham (currently the authorized user) for seven years, be-e coming familiar with the safe use and operation of the sources, as well as becoming familiar with monitoring and leak testing procedures. Under Prof. Hitchingham's r.npenwon, I have beat using the sources and performing various monitoring tests during this time.

I have becn the radiation safety officer for this license as of July 29,1996.

11 Addition of Co-60 source to License During our most recent inspection (1/24/97) the mspection otticer, Mr Mark Mitchell, and myself came anoa a Co 60 hource with a listed activity of 2 mCl as of 7/27/74, making the estimated current activity approximately 100 pCi Neither i nor Psof Hitchingham have evei used this source, and we are still uncertain as to how it came to be in our possession Since it is in our pes-session, however, we will need to modify our licer.se so as to reflect this fact. Again, let me stress that neither I nor Prof Hitchingham have ever used this source, and I have no intention of doing so in the fisture We are rarjucsting only the permission to store it here at our lacility. We apolo-gize for our oversight hi this matter; I assure you it was not intentional. Also, I would hke to point out that the source is, and has been, stored in a safe and appropriate manner.

Submit a complete renewal application with proper fee or termination request at least 30 days before the expiration date of your license. You will receive a reminder notice approximately 90 days before the expiration date. Possession of byproduct material after your license expires is a violation of NRC regulations. A license will not normally be renewed, except on a case-by-case basis, in instances where licensed material has never been possessed or used.

In addition, please note that NRC Form 313 requires the applicant, by his/her signature, to verify that the applicant understands that all statements contained in the application are true and correct to the best of the applicant's knowledge. The signatory for the application should be the licensee or certifying official rather than a consultant.

You will be periodically inspected by NRC. Failure to conduct your program in accordance with NRC regulations, license conditions, and representations made in your license application and supplemental correspondence with NRC will result in enforcement action against you. This could include issuance of a notice of violation, or imposition of a civil penalty, or an order suspending, modifying or revoking your license as speciiied in the General Statement of Policy and Procedure for NRC Enforcement Actions. Since serious consequences to employees and the public can result from failure to comply with NRC requirements, prompt and vigorous enforcernent action will be taken when dsaling with licensees who do not achieve the necessary meticulous attention to detail and the high standard of compliance which NRC expects of its licensees.
