MOTIONS RELATED E STAFF INVESTIGATION Now comes the Conservation Council with motions related to the Staff investigation regarding drug abuse during construction of the Shearon Harris plant. In its letter to the Board dated August 27, the Staff stated that it a
did not have sufficient facts to take a position on the Applicants' Motion for Summary Disposition and that it would seek further information from the Applicants on the matter.
It is further our understanding that these requests for information would be by letter, telephone, and in direct meetings with the Applicants.
i A Staff meeting was held on this matter on Thursday, September 5, at 1
1030 a.m. in Bethesda, Maryland.
Intervenors were notified by Mr. Bart Buckley (sp?) of the Staff by telephone late afternoon on Wednesday, September 4.
We find it difficult to believe that this meeting was not at least tentatively scheduled at the time of the conference call of August 27 i
and as such we should have been informed of the meeting then.
This untimely and unreasonable notice does not give Intervenors
'1 enough time to make arrangements to attend the meeting (or have an agent i
attend it in our behalf).

This contention regarding drug abuse during construction is a very serious one which has significant safety-related ramifications.
Additionally, it is further an ongoing matter under litigation and as such needs to be handled openly with full notice to the Intervenors of all matters which transpire between Staff and Applicants.
THEREFORE, the Conservation Council moves that the Board order he

following:
- 1. That all written requests for information regarding drug abuse at the Harris plant from the Staff to the Applicants and the responses by the 1
Applicants be timely served on all parties.
- 2. That all telephone calls and direct meetings between Staff and Applicants regarding this matter be duly transcribed and timely served on all parties.
- 3. That reasonable notice of at least 10 days be given to the other parties before Staff meetings and/or meetings between Staff and Applicants regarding this matter to allow Intervenors the opportunity to attend the meeting or to send an agent.
4.
That all meetings of the Staff regarding this matter be transcribed and timely served on all parties and futher that any meeting summaries prepared also be timely served on all parties.
5.
Any other relief that the Board deems just and proper to facilitate the fair hearing of this matter.
