1.0 INTRODUCTION

j By application dated November 20, 1996, as supplemented by letters dated j

Tobruary 20, 1997, and March 25, 1997, Omaha Public Power District (0 PPD) requested changes to the Technical Specifications (Appendix A to Facility i

Operating License No. DPR-40) for the Fort Calhoun Station, Unit No.1. One of the proposed changes would revise Section 5.2.

The changes include relocating specific controls for working hours to the Updated Safety Analysis i

Report (USAR).

l The February 20, 1997, and March 25, 1997,. supplemental submittals (including the inclusion of an Appendix B to the license that documents the relocation of working hours to the USAR) provided additional clarifying information that did i

not change the portion of the initial no significant hazards consideration i

determination that addressed the proposed change in working hours requirements that was published in the Federal Register on January 2, 1997 (62 FR 131).

2.0 EVALUATION j

On February 11, 1982, the NRC published (47 FR 7352) the " Policy on Factors Causing Fatigue of Operating Personnel at Nuclear Reactors." In June 1982, j

the NRC revised the policy and subsequently disseminated the revision in i

Generic Letter 82-12, " Nuclear Plant Staff Working Hours," which recommended 4

that licensees incorporate specific working hour limits in the technical f

specifications to minimize the potential for ursonnel errors resulting from fatigue. The staff subsequently determined tiat few events at U.S. nuclear plants have been attributed to inadequate control of working hours and that control of working hours through administrative procedures provides reasonable assurance that personnel overtime will not jeopardize safe plant operation.

2-control of working hours through administrative procedures provides reasonable assurance that personnel fatigue will not jeopardize safe plant operation, and that specific working hour limits and associated procedures to limit the potential for personnel fatigue can be relocated to the USAR, or other licensee controlled documents incorporated in the USAR by reference, for which future changes can be made pursuant to 10 CFR 50.59.

The licensee stated in its February 20, 1997, supplemental letter that overtime will remain controlled by plant procedures within the USAR generally following the guidance of the Commission's policy statement on working hours contained in Generic Letter 82-12, " Nuclear Power Plant Staff Working Hours."

Additionally, a requirement would be added to procedurally require a monthly review of individual overtime.

The licensee proposes adding a requirement for the monthly review of individual overtime by the Department Manager, Manager - Fort Calhoun Station, or their designated alternates, or higher levels of management, to ensure that excessive hours have not been assigned. The proposed requirement is consistent with the guidance provided in Generic Letter 82-16, "NUREG-0737 Technical Specifications," NUREG-1432, Rev. 1, " Standard Technical Specification, Combustion Engineering Plants," and the changes that will be incorporated on a generic basis to the standard technical specifications.

The staff concludes that the proposed requirement is acceptable.

The March 25, 1997, supplemental submittal documented licensee agreement with the inclusion of an Appendix B to the license, which lists additional license conditions. The subject license condition documents the relocation of working hours to a licensee-controlled document (USAR).

The proposed amendment is consistent with current licensing practices and operating experience and provides reasonable assurance that personnel overtime will not jeopardize safe plant operation. Accordingly, the staff concludes that the proposed changes to TS 5.2.e are acceptable.

3.0 STATE CONSULTATION

i In accordance with the Commission's regulations, the Nebraska State official was notified of the proposed issuance of the amendment.

The State official had no comments.

4.0 ENVIRONMENTAL CONSIDERATION

j The amendment relates to changes in recordkeeping, reporting, or administrative procedures or raquirements. Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10).

Pursuant to 10 CFR 51.22(b) no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendment.

5.0 CONCLUSION

The Commission has concluded, based on the considerations discussed above, that:

(1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public.
