SUBJECT: NRC INSPECTION REPORT 50-454/96013(DRS); 50-455/96013(DRS) AND

NOTICE OF VIOLATIC'N l

On March 10,1997, the NRC completed an inspection at your Byron Station, Units 1 and l

2. The enclosed report presents the results of that inspection which included a review of

activities relative to the Byron fire protection system.

Based on the results of this inspection, certain of your activities appeared to be in violation i

of NRC requirements. The violation is of concern because the inspectors identified your

'

failure to implement effective corrective action to prevent freezing of plant fire protection

- equipment during the previous and current winter seasons. Additionally, corrective action

violations were identified in Report Nos. 95009,96006 and 96012. The previocMy cited

violations show that ineffective corrective action is not limited to fire protection ac.tivities 4

and indicate a need for enhanced management attention to assure that deficiencies are

identified and effectively corrected.

We are also concerned with your established practice of allowing fire protection valves to

remain in the as-left surveillance position for indefinite periods pending resumption of

suspended surveillances. While the affected fire protection valves have not, to date,

resulted in fire protection systems being inoperable, we are concerned that this practice,if

continued, could result in inoperable fire protection equipment.

Additionally, we request that you respond to the unresolved item identified in Section F1.3

of the enclosed report. Your response should address the basis for your determination

that the reactor coolant pump lube oil collection system was not outside the Byron

Appendix R design basis prior to the modifications performed in July 1996.

The violation is cited in the enclosed Notice of Violation (Notice), and the circumstances

surrounding the violation are described in the enclosed report. Please note that you are I

required to respond to this letter and should follow the instructions specified in the

. ~ enclosed Notice when preparing your response. The NRC will use your response, in part,

to determine whether further enforcement action is necessary to ensure compliance with

. regulatory requirements.
