COMSECY-96-053 STRATEGIC ASSESSMENT ISSUE PAPER: OVERSIGHT OF THE DEPARTMENT OF ENERGY (DSI-2)
I strongly support external oversight of DOE facilities as this will result in better assurance that public health and safety is adequately protected, ensure public scrutiny over health and safety issues, and increase public access to the process of managing the risks and benefits of the uses of radioactive materials. I support option 1b as outlined in the paper. This option is supportive of Commission responsiL;lity for oversight of DOE facilities. I agree that responsibility for oversight of industrial safety should be with OSHA.
l I would like the staff to consider the phased implementation of transfer of authority for regulatory oversight proposed to be used in State agreements as a possible model for the oversight of DOE. We should evaluate DOE sites not on the basis of function, but rather on the basis of complexity in meeting NRC standards. '
I agree with Commissioner Rogers that it is of the utmost importance that NRC l remain a credible regulatory body and that the current safety culture of NRC is not compromised. I do not believe, however, that these concerns should cause us to reject this opportunity to improve and to make consistent protection of public l health and safety nationwide.
