COMSECY-96-053; OVERSIGHT OF DOE (DSI-2)
Section 3.1 of the Phase ll, " Stakeholder Interaction Report" discusses the public comments and Commission Preliminary Views on the subject of Oversight of DOE. I have reviewed the information provided and have concluded that the Commission's..
preliminary view should be modified to reflect NRC willingness to take responsibility for regulatory oversight of certain DOE nuclear related facilities, based upon DOE's publicly expressed intent to seek transfer of regulatory oversight responsibility for certain DOE nuclear related facilities. A cautionary note should still be maintained which reflects that this support is subject to having adequate resources provided by Congress.
Therefore, I propose that the Commission's final view state general support for Option 1
- 1. However, since NRC and DOE are currently engaged in preliminary discussion regarding the feasibility of the types of facilities that would be subject to extemal oversight, the time frame in which oversight responsibility for those facilities may be transferred, and the funding and resource commitments that may be required as a result of this added oversight responsibility, I would s'Jggest that it is not necessary for the Commission to add specificity to its support of Option 1 at this time.
Excellent public comments were received relative to the NRC accepting regulatory oversight responsibility of DOE nuclear facilities. I strongly urge the staff to review and consider these comments during the development of their implementation strategy for DOE nuclear facility oversight. My experience suggests that most if not all of the facilities will present unique and complex regulatory challenges. Clearly, many technical and programmatic issues need to be resolved prior to implementation, some of which have been posed by Commissioner Rogers in his January 17,1997, memorandum on this subject. It is imperative that the NRC moves very cautiously in this arena, j
