j After consideration of the public comments on this DSI and your responses to my memorandum on the policy of requiring Agreement State reimbursement of certain NRC costs (COMIGJD-96-004), I have concluded that the Commission should proceed with finalizing its preferred option on this matter subject to the following modifications:

l 1. The present policy for requiring Agreement State reimbursement of NRC costs associated with training and technical assistance should l

be modified to allow NRC funding of such costs in those instances where Agreement States demonstrate that State funds are not j avaliable or cannot be used for these purposes. Staff should develop proposed criteria for Commission approval for this purpose. The Criteria should be stringent enough to provide l

adequate assurance to the Commission that the State has thoroughly explored funding alternatives available to it and a determination at a high level has been made that none are available,

" for example, certification by the State agency head, deputy or financial officer. In such cases, States should also explore partial funding, e.g., payment of travel costs but not training tuition or reimbursement for selected NRC training or assistance. l . therefore,in the public interest. The staff's proposals should be provided to the Comrnission in a time frame that would allow l implementation of the modified policy beginning in FY 98.

l' 2. Staff should develop cost-effective alternatives for providing

! training and technical assistance to the Agreement States. As an

! example, increased use of videoconferencing could become a cost-l effective alternative to some on-site technical assistance to l Agreement States. As another example, the use of training videos

! coupled with proctored examinations could become a cost effective i alternative to sending students to training sites for selected i

courses. Staff should provide the Commission with a report of j available alternatives and their recommendations for assuring that NRC training and technical assistance to the Agreement States are l

provided in the most cost-effective manner possible.

! 3. The States should be encouraged to join the Commission in asking i for Congressional relief from the Consolidated Budget Reconciliation Act of 1990 requirements insofar as it applies to i

activities of the NRC that do not directly benefit NRC licensees such 4

as training and technical assistance to the Agreement States.
