COMSECY-96-054, NRC'S RELATION HIP WITH AGREEMENT STATES (DSI-4)

I continue to support the Commission's preliminary decision on this Direction-Setting Issue (DSI) subject to the following i modifications.

With regard to the funding of Agreement State travel and technical assistance, I am in. favor of the staff developing  ;

criteria, for the Commission's consideration, for determining whether the NRC should fund Agreement States if stat.e funds are  !

either unavailable for such purposes or state funds cannot be used for such purposes.

I agree with the comments of Commissioner McGaffigan on the issue of whether the NRC should use either intangible incentives or

" seed" money to encourage States to become Agreement States. The public comments received on this issue did not support the concept of providing either tangible benefits or " seed" money for this purpose.

I I would also like the staff to examine cost-effective alternatives for providing Agreement State training and technical assistance.

In the longer term, I believe that NRC should request Congrens to enact legislation that would exclude Agreement State funding from l

the NRC's user base and provide a separate appropriation to cover these costs. The Agreement States themselves need to be more proactive on this matter, and more forthcoming with methodologies i I

for having the Agreement States shoulder a larger share of the expense of travel and technical assistance.
