POSSIBLE MATERIAL FALSE STATEMENT CONCERNING U-BOLT SUPPORTS AT COMANCHE PEAK STEAM ELECTRIC STATION Your memorandum dated November 26, 1984 requested my consideration of whether Texas Utilities Electric Company (" Applicants") had made a " material false statement" warranting enforcement action in a statement Applicants made to the Atomic Safety and Licensing Board concerning U-bolt supports at the Comanche Peak Steam Electric Station. My memorandum dated March 21, 1985 informed you that the statement could be viewed as a material false statement but that additional information was needed to detemine what enforcement action, if any, is appropriate.

Since then, the Comanche Peak staff has concluded that while the Applicant's sample was not random in the pure statistical use, it was reasonably representative and that the applicant's characterization of their field survey as " random" and " representative" is not technically important from the standpoint of safety with respect to stability o/ the pipe supports and stresses and in the U-bolts and supported piping. (Your memorandum dated June 28,1985.) In light of this technical conclusion concerning the statement, my staff has detemined that the statement is not a material false statement within the meaning of Section 186 of the Atomic Energy Act, as amended.
