SUBJECT:

In the Matter of Application of Texas Utilities Generating Company, et al . for An Operating License for Comanche Peak Steam Electric Station Units #1 and #2 (CPSES) Op Docket Nos. 50-445 and 50-446 NRC Staff's 8/20/85 Board Notification -

Staff's Determination of Applicants' Potential Material False Statement on U-Bolt Sample (Board Notification No.85-077) l CASE has just received subject letter from the NRC Staff to the Commissioners.

We respectfully request hearings on the matter of the Applicants' statement on the U-bolt sample, which CASE considers to be a material false statement. CASE does not consider that the unsworn statements provided to the Staff by Applicants, without benefit of cross-examination by CASE, is sufficient grounds for the Board to make the determination that Applicants ' statement was not a material false statement.

We believe that CASE's previous pleadings have provided sufficient information to clearly show that there is a genuine issue of fact which is in controversy.

l In the alternative, should the Board believe that it already has sufficient l infomation to determine that Applicants' statement does constitute a material false statement (in line with the Board's 6/29/84 Memorandum and Order (Written-Filing Decisions)), the Board should now so rule.

Respectfully submitted, CASE (Citizens Association for Sound Energy) 8509030373 850826 PDR ADOCK 05000445 G PDR trs.) Juanita Ellis, President cc: Service List (to Board c/o Judge Bloch by Federal Express .8/26/85; to balance of Service List by First Class Mail 8/27/85)
