NOTICE OF VIOLATION

Dear Mr. O'Hanlon:

On September 21, 1996, the NRC completed an inspection at your North Anna

Power Station. The enclosed report presents the results of that inspection.

'

During the 6 week wriod covered by this inspection period, your conduct of

activities at the

iorth Anna Power Station was generally characterized by

safety conscious operations.

However, a v

alion was identified by NRC

inspectors in that an action to mitigate o Fuel Handling Accident was not

appropriately implemented in abnormal operating procedures.

The violation is cited in the enclosed Notice of Violation, and the

circumstances surrounding the violation are described in detail in the

enclosed report.

Please note that you are required to respond to this letter

and should follow the instructions specified in the enclosed Notice of

Violation when preparing your response. The NRC will use your response, in

part, to determine whether further enforcement action is necessary to ensure

compliance with regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice", a copy of

this letter and its enclosures will be placed in the NRC Public Document Room.

During an NRC inspection conducted on August 11 through September 21, 1996, a

l

violation of NRC requirements was identified.

In accordance with the " General-

Statement of Policy and Procedures for NRC Enforcement Actions," NUREG 1600.

l

!

the violation is listed below:

(

Technical Specification 6.8.1 requires that written procedures be

l

established, implemented and maintained. including by reference to

l

Appendix A of Regulatory Guide 1.33 Revision 2. procedures for

!

irradiated fuel damage while refueling. The licensee's Technical

l

Spc<ification Change Request dated October 17, 1995, and the NRC's

l

Technical Specification Amendment numbers 198 and 179, dated

February 27. 1996, stated that upon notification of a fuel handling

accident, the control room bottled air supply would be initiated by

operators within two minutes.

Contrary to the above, from February 27, 1996. until September 19, 1996,

the rocedure for irradiated fuel damage while refueling, 0-AP-30, was

ina

ate in that it did not direct operators to initiate the control

room

ttled air supply within two minutes of notification of a fuel

handling accident.

This is a Severity Level IV Violation (Supplement I).

i

Pursuant to the provisions of 10 CFR 2.201. Virginia Electric and Power

Company is hereby required to submit a written statement or explanation to the

U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk. Washington,

D.C. 20555 with a copy to the Regional Administrator. Region II, and a copy to

the NRC Resident Inspector at the facility that is the subject of this Notice,

'

within 30 days of the date of the letter transmitting this Notice of Violation

(Notice). This reply should be clearly marked as a " Reply to a Notice of

Violation" and should include for each violation:

(1) the reason for the

violation, or if contested, the basis for disputing the violation. (2) the

corrective steps that have been taken and the results achieved. (3) the

corrective steps that will be taken to avoid further violations, and (4) the

date when full compliance will be achieved. Your response may reference or

l

include previous docketed correspondence, if the correspondence adequately

addresses the required response.

If an adequate reply is not received within

the time specified in this Notice, an order or Demand for Information may be

issued as to why the license should not be modified, suspended, or revoked, or

why such other action as may be proper should not be taken. Where good cause

is shown, consideration will be given to extending the response time.
